Not necessary to litigate copyright infringement (unless you are suing for huge money) if it's not registered it limits the possible amount that can be awarded.

You still need proof that it's yours and a creation date on an image file doesn't cut it. I assume you have some other form of federal documentation that proves the photo is yours?
