idk maybe you took my comment as an attack or something other than simply MY .02$, but w/e good for that you beat your tickets...
It just irritates me to have misinformation spread around like its gospel with an extra sensation of condescending douchebaggery, and little effort in actually helping, especially when I know better. Its the kind of "suggestion" that benefits no one especially when it is wrong. I didnt take it as an attack. You werent even speaking to me so it couldnt possibly be an attack on me. I took it as being severely incorrect. And its not an opinion when you say definites and absolutes like "The only way and I mean THE ONLY way", its the same as saying "always" or "never". Thats black and white. Those imply that what you are saying is fact, not opinion. Which, in fact, they are not. On top of that, no where does it say that that was your opinion. It was a definite imperative declaratory sentence. It wasnt, "in my experience" or "in my opinion it is a waste of time". Just "Otherwise, you are just wasting your time". Point blank. "Because 1 of my family members tried it, it must not work." ;) On top of that, you add an extra degree of douchery when you snipped "Have fun funding California's debt." That little nugget of asshole-osity was just uneccessary, so when I see a response like that, I answer in kind........ I know this is r3v, but try only being a dick when warranted. Thats all Im saying.

The internets is srs bsns!! haha

No where in the CVC does it say that it is Illegal to go above the posted limit (unless its on a highway where even then there are extenuating circumstances as to being able to shortly be travelling above the posted limit). It DOES say that it is too fast for the conditions.

On the street is is completely legal to go above the posted limit (within reason of course) if "the conditions permit". So you go about proving that there was absolutely nothing about the conditions that made your speed unsafe. It is a "suggested" speed that is arrived at by reducing the speed survey's average speed by 10% and then rounding down to the nearest 5. I have beaten more than my fair share (at least 6, Ive lost count over the years) of speeding tickets for myself AND my family and friends, so your "wasting your time" decree is also erroneous. These were decided by a judge who knows about the laws more than anyone. And the "only way to beat a speeding ticket" comment is also wrong because the cop can choose not to respond to the call for his version of events to the judge in which case, even if all you put down is "I am not guilty", you win.

Another way is to allege that you were speeding up to avoid a dangerous situation on the road by passing another car and picking up speeding up temporarily. Yet another way is to prove that your speed was NOT dangerous due to the conditions at hand by using the cops own admission (on the ticket) by proving the weather was clear, it was light outside and visibility was good (thereby squashing the charge) because the speeding code they use states that"you are going to fast for the conditions. So, by simple reason of mathematics, there are more than one (the only) way to beat a ticket.

"Grantlacey" literally JUST recounted another "way" to beat a ticket, so there cant be an ONLY way, if there are more than ONE. So you literally are wrong on all counts. Before giving "suggestions" based on one experiece that your brother had. Learn a bit about the CVC and try beating multiple tickets by declaration and succeeding before giving your assumed-iron-clad "knowledge". This is exactly the kind of ignorance that keeps people paying tickets unnecessarily and keeps the municipalities and cities dependent on traffic tickets for funding unethically-written tickets.

    No. 1. Traffic School?

No. 2 Go see the Clerk of Court, plead not guilty. They are going to give you a trial date. 20 days before the trial date, go see the the COC and request for an extension. Chances are, the officer will not remember the case and will not appear. If he appears, you can ask how we determined your speed. If he clocked you with a radar. Radar should be calibrated with a tuning fork and documented. Request for the document.

If he paced you, the patrol car's speedometer should be calibrated and documented. He should provide that document. If he can't provide, motion for dismissal.

No. 3 Hire a lawyer for $500 to represent you. Choyce Law Firm in SF. Let me know how it goes. I've gotten out several speeding tickets by appearing in court. One time I got off while the officer was there in court to prove his case. I was going over 100mph. Long story, I won. Right now, cruise control is my best friend.

    No. 3 Stop speeding!

I am going to fight it using Trial by Written Declaration. I am just a little confused on the whole process. I have the form to request a written trial. Do I bring that the day of my trial on my paper and give it to the clerk?
Should I extend my court date once and then request the written trial?

I also need a little bit of help on what to write. I'm going to fight that the speed was not unsafe for traffic and weather conditions, because it was sunny outside with very low amounts of traffic. I am going to say that the motorcycle cop did not write the number of his lidar gun on the ticket and he has to prove his was calibrated.
I also am going to request that a speed survey be provided by the cop to prove that my speed was unsafe.
Not sure if it matters but I am a full time student and this is my first speeding ticket.
    Is that good?
    please help

One of which is arrived at by taking the average speed of traffic on that road, subtracting that by 10% and then further reduced by rounding down to the nearest mutiple of 5.... It is not for safety. It is blatantly a money maker and it is one that cops and municipalities benefit from all the misinformation and myths about it. In the CVC it states that if the conditions permit, it is completely legal to go above the posted limit. Furthermore, no where does it state that you can NOT under any circumstances go faster than the posted speed limit. So whatever the cop tells you about that, is complete bullshit. The courts know that no one wants to go to court to fight this so they just pay up, they take advantage of that. They also make no mention ANYWHERE of being able to fight it through mail. Now, why do you think that is?? FIrstly, the cop doesnt get paid overtime when having to write his version of events to the judge in your case, unlike when they turn up for court appearances where they do get paid OT. Secondly, there is very little chance that wthout seeing your face, the cop will remember the specifics of your case through the mail when he has to recall a speeding ticket he issued 2 months ago. ANd thirdly, a lot of times they are too busy or just dont care enough to write their version of events back to the judge, in which case you automatically win, even if all you wrote on your paper was "Im not guilty". You still win. Fourthly, even if you do bring a good case to court, there are very few judges that are willing to go against an "officer of the law" in open court so the odds are more than stacked against you, yet conveniently, they dont mention that there is a much more fair and convenient process to your regular citizen. People take the cops word as God and its just not so. Blind obedience is never good, and the courts and municipalities know they have a cash cow in the fact that most people believe there is no chance to beat a ticket. But, including our friend here, I have witnessed and personally been responsible for getting myself off of 3 tickets and my brother 2. Not to mention people I have put up on game that have been found not guilty. Its not just a fact of "Just dont go above the posted limit" thats like saying "Oh, well just dont complain when they lower your pants and rail you, itll be easier on you". They blatantly and without remorse or consideration are taking advantage of the ignorance of the people so its not fair to talk to the ones that ARE enlightened in a negative way. Plus their whole premise is false anyways and the cops get away with issuing bogus tickets so its not like they have great moral footing either, if you want to argue it like that.

in general, if you are a college student trying to save money by avoiding tickets, the first step is to stop speeding. this is coming from a recent college grad who was pulled over several times while he was in college, sometimes for pretty stupid things. it just isn't worth it.
