    Invest in a go pro that can stay on your dash lol. if accident occurs bring it out and advise that conversation is being recorded and any thing they say or do may be used against them in the court of law LMFAO.

    Seriously, everyone & their mom should have a disposable camera in the car. It's seriously $2-5 & I know whenever I have been in an accident or even my own mother who taught me that rule. We make sure people are ok & start snapping pictures. Car accidents are a war & you should trust no one.

    for that reason exactly every time you get pulled over or get in an accident, pop out your phone and make a voice recording. also put a sticker on your car somewhere saying something like "people in the vicinity of this vehicle may be subject to audio surveillance"

    Same deal happened to my mom, private parking lot, guy admits he was at fault on site, but when he talks to his insurance he puts full blame on the other person.

    Yeah but truthfully I don't have the best track record with insurance companies. Not for accidents of my fault, but for claims in general. Such as my totaled Zinno, completely not my fault, but since money came out of Allied's pocket to cover my uninsured motorist property damage, I'm sure my premium will spike too. And that was two months ago-at 20 years old, I'm going to be seen as a liability whether it was my fault or not (like in this situation) I just didn't want to have to deal with the whole process again of explaining the situation, and leaving the decision up to some flunkie adjuster. He seemed like an honest guy, admitted guilt in which he was clearly in the wrong, offered to pay cash like it wasn't a problem at all, and once he realized the costly repairs of a BMW (damage isn't all that bad, he was thinking $300) he decided to flip the script and weasel his way out of it.

    Thank you for the condolences, and yes it blows I got screwed on my two vehicles in two months. As for the Zinno, my uninsured motorist coverage paid me $3,500 then I sold the entire body to a friend of the previous owners (both stand up guys) for $2,100 and the person at fault responded to my demand letter rather quickly. I demanded $4,000 out of court or $6,500 if we went to court. (He's making reasonable monthly payments, I didn't want to ruin his life demanding a lump sum otherwise he would have literally been on the streets. I had some moral issues come into play on this one, so I agreed on monthly payments.) So all in all I got a great payout, but lost my prized possession.

    Let the insurance companies handle it. Call his first and file a formal claim. Then call yours and tell them the same. Demand an independent adjustor come to the scene with both parties to get an accurate depiction of what happened. If you are clearly in the right, you have nothing to worry about.

    Taking any other action such as sending a threatening letter could hold up the process. Taking him to small claims court could be a waste of time.

    This is why he and you have insurance. Take advantage of a service that you pay for.
