So are you saying if someone rear ends you while your just sitting there it's still both parties fault? Or it can be both parties fault if in any way you contributed to the accident like if they claim you slammed on your brakes?

...leave it to a lawyer and they can claim that without your car sitting there the accident would not have happened!

yeah man. ill keep you guys updated on what happens. i believe a police report has or will be written today and sent to insurance companies

thats what i initially thought. but apparently they dont do that anymore. the police simply list the facts. they dont blame anyone at the scene of the accident. thats what the officer told me. but i can also use him as a witness or something. im not totally sure. still trying to figure things out

when i got t-boned in my old slicktop in the city i had the police do a report, called the station the next day to get a copy of said report. the person on-call said in the file the other driver was indicated at fault.

maybe it was because in my sit. there was a clear definition of who had the right-of-way.

just keep fighting it, almost took me 6 months before I won mine without a salvage title tacked on.
