Do you even understand what "refute" means?

Refute means to succesfully defeat an argument or prove it wrong, not just argue against it.

It protects ALL citizens from Government (you're correct on that point), AND protects minority groups from an unjust/illegal/Unconstitutional majority will.

It shouldn't be about religion but ethics.
After a relatives funeral, you don't go pitching tents at the graveyard, building a trance and hiphop stage, dancing, paryting and drinking till the sun comes up and throwing up on tombstones.
There's nothing to ban, but the people wanting to build the mosque should realize that it's unethical to do so there and now, provided they have the brains and morale.
