      Is the decision to answer a simple question regarding your citizenship protected by 5th amendment rights? Either way, these folks/this guy is obviously picking a fight with the BP agents, whether you like it or not, for propaganda points. Put yourself in the BP officer's shoes, where you just want to go home at night, and get through the day......and part of getting through that day is asking a basic question that is required of you......a question that has most certainly been vetted by the BP's legal counsel, unless you think they are absolutely intentionally self defeating in nature. Are you a US citizen? Yes.......ok go along with your day. I've passed through the checkpoints many times in socal/AZ and have yet to ever have an issue. It isn't surprising that these folks found an issue when they caused one.

        Thats not the point is it.


        Just because an agent of the state asks you something does not mean you have to answer or comply. They are out there on a fishing trip, and complying with a fishing trip is 100% voluntary even if the agents of the state are playing like its not. With out probable cause that you have committed or are committing a crime they have no reason to detain you or impede your lawful travel. Your refusal to comply with their questions during a stop like this does NOT constitute probable cause, they are left with little recourse other than to let you continue on your way. If they do detain you they are opening a legal can of worms that can be sticky for all parities involved.


        Yes I understand they have a job to do, and sitting on the side of the road 100 miles inland of a boarder harassing every car that comes down said road for the "crime" of being on said road is the issue NOT them doing their job. On the flip side of this, they signed up to for this by putting on the badge and cashing the pay checks. They signed up to deal with this shit, so they get what they get and is all part of the job they signed on to do.

          Soft tyranny.

          And let me tell you, the urge to just give in and comply to make the issue go away because it is undeniably uncomfortable will net in nothing but more infringement. Two factions of people have guns in the world; criminals and government and there ain't much between them.
