it's coming back, because it's an issue that gets at the eart of the role of Government in America. And it doesn't take effect for a while- long enough for the people that did it to escape from the after math. Stand-up politiking right there.
its not dead. it still reasonates daily in the circles i travel in at least. i think it doesn't get the press it once did cause it supposedly is in the past.

Essentialy it cannot be repealed for another 2.5 years at least. Americans (hell, humans in general) tend to be fickle and short-sighted. Especially when it comes to politics. By the time the 2012 presidential election rolls around (even if the republicans have picked up the house, senate and white house) there will be some other hot ticket item to focus on. outrage will have long since subsided and it would be nearly impossible to repeal it, let alone get a fillibuster-proof majority on the repbluicans side to prevent the democrats from blocking it's repeal.
Not that I like it either way, that's just the reality of the situation.

The republicans cannot possibly get a 2/3 majority this fall. There aren't enough seats up for re-election to make the numbers work out. Even if they won every single seat up for grabs in the entire Congress, they couldn't get 2/3. So yes, I did go to civics in high school. And math class too

Yes you are very correct, on both counts, but the is still a possibility of the flip flopping politicians to change their votes/support all willy nilly as the winds of change start to prevail the to the other side.
