Mike, I think you're overreacting a little. He's responding to your PMs and has even apologized. He's not dodging or avoiding you. There's not reason not to trust him.

I also agree, that when people are selling a "single-mass" flywheel, it's generally accepted that flywheel is from 87+ 325i and not 84 325e. Seller told you that he didn't know there was a difference, and neither did you. Mistake is on both ends. His for not knowing, your for not asking.

Settle this like grown ups, guys.

General business practice is to return the item before receiving a refund. U have proof of return via a shipping receipt in case legal action needs to be taken.

In the only world of forum sales I always find it funny that the system works like this...

Pay first and assume you will get the item(s).

If there is a problem or anything you don't get the money back first, you are expected as the buyer to send the item back and get your money back. Both times as the buyer you take the risk of being ripped off.

That's how it works with any business as well, and they can just as easily rip you off too.

I think this is illogical. If he refunds you before you return it, isn't he in the same situation as if he shipped it to you before you paid? Your refusal to return the item before refund is not normal practice (as many have told you) and your insistence on deviating from custom probably makes the seller (and others) wary of your motive.

At this point I'd be more inclined to do business with the seller than you. Hope you guys can work it out.

My first thought was– send it back, then get the refund.

I say if you trusted him to send you the flywheel, why can't you trust him to refund you once he gets the flywheel back? He's communicating, so it seems to me he WILL give you the money back once he gets the flywheel. You point out he's not a business, which is right, but he's also not buying a flywheel from you so I can't see why you expect him to refund you first. In short, it looks like if you ship him the flywheel, he'll refund your money and you'll both be happy.

                    Youre an idoit.
Return the item. Get the refund. I have bought/sold tons of parts and that is always how it always has worked.

Good luck. You will loose the paypal claim too. Paypal will tell you to return the item and youll get a refund.

I know a compromise could be worked out. You both are good people from my experience and from what i've read on this forum, soiling each others names is bad for both of you....@broke30 could you send him money for shipping the part back as good faith or do a 50/50 thing and send him the balance when the part is received?

Hey white325is! Just happened to come across this thread. Hey bro, you're going to have to step out on faith on this one. If you leave it as it is, you'll have a fly wheel you can't use and be out 60 bucks.

On the flipside, send him back his stuff and document that you sent it back. Then, if you don't get your money back, file a claim at paypal, siting this thread.

You'll be on the moral high ground and it'll be up to the other guy to make good.

Else, leave it alone and just sell the flywheel on ebay.

Either way, it's not worth the frustration to stew on this anymore. Hope all is well up there in PA!

Another good transaction with Max, this time for 5 basketweaves and 4 center caps. All rims and tires were as described in his FS thread. He packed them well and was able to ship them a day earlier than he expected to. We had excellent communication throughout.

Good guy, clean transaction. Would buy from again.
