I have them keeping them. Found a guy in Van Nuys with two replaced the one from accident and one of the front was bent bad so replaced that one to. They needed paint so just paint them all black

At the moment I only have that to my name hence why I can not do deal now even though that was almost a 6 month ago, deal we agreed on. At the time I was working and had the funds but got into a accident. Its been so long that I can no longer do that deal thats why I just want my money back. He never got back to me till now! I just want what is mine and thats it we part ways!

Yes indeed I wanted them about five six minths ago when I had the money. Onky reason I kept rescheduling was due to work I live in Escondido worked in Carlsbad and you were deep in Daygo. As far as the springs I bought was because I did have the money at the momnet, six months ago & he was local! & the car was never "wrecked" I said accident hence why its still drivable. I put the car for sale in the time went MIA. This whole transaction took to long and I no longer can afford them. Thats why I am asking you to please refund my money. My fault for not picking them up sooner and yours for not responding after that. Also remember I am not charging you for the half of the parts and labor for the rear main seal you promissed. Least you can do is refund the funds call it done it go on to our lives!
I read all your posts before making a comment. Jon is a friend as well but I'm going to stick to the business side of our relationship. I felt this an important enough issue to take an hour and a half of my time that I could be could be actually enjoying my car instead of sitting on my computer to voice my thoughts.
First of all Jon is a a rare commodity in our community. He sells 20-25 year old cars with very little margin and alot of work to a community with near new car standards for their 25 year old cars (myself included). He has put many e30's back into the community that would have otherwise been lost to time and neglect. If he wants to make money "flipping" cars there are lots of easier cars to make larger margins on and sell to much less discerning buyers. Why e30's then? Because he genuinely loves these cars and it is a labor of love. I have personally purchased very expensive items from Jon and we both held up our ends of the bargain. A problem that was caused by my oversight he fixed at the expense of time he could be spending with his family and a very patient wife Twice. My friend has bought several very expensive cars from Jon and they all exceeded expectations and he held up post sale agreements as well.
Secondly used cars are sold "AS IS" no warranties expressed or implied. It is the buyers responsibility to conduct a pre-purchase inspection at their own expense which with finances being tight you probably neglected to do. A good mechanic conducting a proper pre-purchase inspection may or may not have caught the rear main seal leaking it's early stages as it is not visible without removal of the transmission so I wouldn't fault Jon's integrity in selling you this car. I bought my first e30 from my friend and the head gasket blew a couple months later, I certainly didn't fault him for not disclosing, I knew I was buying an old car that would need big maintenance items occasionally. In your and Jon's case the timing was unfortunate for the rear main seal to let go, but his gesture of offering to pay half of the repair (probably a good chunk of his slim margin) was very generous considering you bought an old car AS IS.
Thirdly e30's are just the coolest cars to drive around in and own. They definitely have a cult following for a reason and are trendy for teens and young guys. I can definitely understand why you would want to own a nice one like Jon's and roll around on MY previous set of style 5's. The wheels at the heart of this argument were mine and I assure everyone they are a decent set of wheels. As trendy and cool as an e30 may be please remember that this was a 30k car 20 years ago (50k with inflation) and therefore they need proper care and money to keep them from going downhill as they get older and older. Yea you could probably keep the car on life support for a few years as you go through college with no job only spending the little money you have on visual (wheels) and go fast modifications (allegedly attempting to trade for a even more expensive to maintain turbo car) and rarely maintenance unless it leaves you stranded but why? Financially to own an e30 you really do need at minimum a 1-2k financial cushion to own one of these cars and maintain it properly so it may live forever and not just throw it away when its time for the next trendy thing. Your dreams of e30 ownership seem a little unrealistic to me, I would recommend you buy something newer for less money (I was a client advisor At BMW btw so I don't think my thoughts are unwarranted) and keep the rest in the bank for maintenance especially with no job. When I was in college I got a job to support my e30 addiction because the parents aren't going to pay for your sportscar, and yes it is a sacrifice.
Fourthly in your original post you mentioned having entering into an agreement to purchase the style 5's and paid Jon $200. Everything that happened after that point was you not following through on your end of the deal why should he return your money on something you had given your word? It's not like he promised something and didn't deliver, he still wants to complete the transaction you just need to show up. Additionally you have 16" tires already you can swap them onto the new wheels. I agree the accident put you in quite a pickle as far as this deal went keeping your end of the bargain and probably a financial setback as well. It would be interesting to see a timeline of when Jon had your style 5's ready for pickup vs. when your car was allegedly hit, if you had let an unreasonable amount of time pass this would also be a demerit to your argument. Living 40 miles away is no excuse, thats an evening of your time you act like it is 400 miles and a two day trip. Thousands of people flake on buying things on R3V myself included and this is a classic example of the attitude that perpetuates among many on this forum making it very frustrating to do business on R3V. I think it is fair for Jon to take a stand. I personally had 10 buyers on here say they wanted to buy my Recaros, asked for my paypal and then disappeared into thin air and I had no recourse for them wasting my time. So when was that "accident" of yours OP? Got any documentation, pictures, or anything that would be credible in court? So how bought them vaders you were selling last month OP? You made $400 off that last month I assume, so where did the money go? Sounds to me like your bad at managing finances. And you even mentioned that you're an unemployed college student. Hell, you couldn't even get a sub-prime loan when those started in 2007 since you have little to no income. You've just acknowledged that your bad at managing your finances.
Now let me break it down for you from a legal standpoint.

Technically the seller doesn't have to fix it unless it is stated within the contract / agreement between the parties that there is a warranty upon purchase of the car.
Mean time I was also trying to trade the wheels that had came with the car I purchased from him (Fittipaldi OZ Route) + cash from some filled and re-drilled 16 style fives. So I transferred $200 into his account and we were to later meet for the exchange of wheels.
Now see.... this is what they call a unilateral contract. You are making the offer to trade and it is up to him to accept or decline. If he accepts, it is now a bilateral contract. So... If I read this correctly, you wanted to trade the rims that came with the car for re-drilled style 5's and you would also give him $200 cash for em. Correct me if I'm wrong with that judgement since your sentence structure is horrible. Therefor you put a $200 downpayment and now it is up to YOU to give him the rims.
I still had to buy tires for the style fives. Something came up where I could not afford tires anymore & my car was in hit in the back right hand wheel. Making the wheel not fixable. I informed Jon of what had happened and asked if he could refund my money....
I assume at this point you were going to buy the tires first, then put on the wheels after making the trade, correct? Now you say your car was hit from the back and the original wheels were not fixable. Do you have pictures or any sort of evidence because hearsay is usually thrown out in court. Now... Somewhere down the line you gave him the 2 good rims but not the damaged one, correct? Again... it is hard to sort through the mess that are your posts / "evidence". What side was damaged and why didn't you give him the other side that wasn't damaged? Did you end up squeezing your car into a compacter or something? Because from the pictures on your vader thread from the previous month, it does not look like that. Can you even prove that the wheels were damaged or did you sell them for some quick cash and are in the process of obtaining new ones? Oh wait... that's right you have $80 to your name and are unemployed... no way can you buy those 2 replacement rims.
Now from reading the other messages and excuses from the thread on why you could not pay, the jury has just concluded that you tried to wiggle your way out of a bilateral contract and you will have to pay the difference. If your lucky, you'll get court fees added onto that for being a smart ass punk. If your even luckier, you'll have to reimburse Jon for damages.
TLDR Version... OP you're in a no-win situation. Grow a pair and accept the consequences of your actions.

Yes I understand that situation like this are usually "as is" but when I contacted him he said he would pay for half. Therefore he also flaked like I did on our wheel deal right? I'm saying we agree we both flaked call it even and he refund my money and done.
