I sold this individual a 413 Red Label DME with a Active Autowerkes chip that was tailored to hs swap. I had purchased this DME for a bimmerforums member but was sad to find out it would not work for my swap. On 4/11/2008 I received a message that he could not start hsi car. I attempted to solve the issues involving his claim about the merchandise I sold him and he was not willing to accept instead he responded.
I bought the ECU from you originally as it seemed the most cost effective way at the time. Since then I have been able to find the ECU's for a lot less than I had originally thought I could (have found several on the Web for less than $75)
$175 for one is more than what I would have to pay for one, so it really doesn't make sense if I can get one for $75 or less.
If you would send me the silver 413 plus $275 I could live with that. Since I'll have to spend around $300 for the proper chip with EWS delete, etc it would only be $25 more than what I spent originally with you ($350).
My intital offer having been snubbed and met with such demands I responded.

I don't really think that asking for a working product is asking too much of you. I understand you have doubts about this, I would too. All I am asking is that we figure this out.
The shop I took it to is going to put a stock chip back into it and see if it fires up their car. If it does then we know the performance chip is bad; if it is then I would expect you to provide a replacement chip. If the stock chip doesn't fire up the car then I will assume the ECU is fried and I'll accept that somehow it got fried when I installed it.
As I stated earlier, I'm not asking for anything other than a product that works.

I bought a chipped ECU from you. It didn't start the car. I took the ECU to the shop that works on my car and it wouldn't start their car. They were going to put a stock chip back in the ECU to see if it would start their car. In the meantime I bought a stock 413 Red label ECU. I didn't touch the car between taking out the ECU I bought from you and putting in the one I bought. I put that ECU in the car and it started immedately.
That is the extent of the story. Your ECU doesn't start any car, therefore it is defective somehow. It doesn't really make any difference why it is defective, only that it is.
I'm not trying to get something for nothing, I just want a product that works. If you have to buy another chip or ECU to ensure they function properly that is your burden. You took my money so you should provide me with a working part. That's all I'm asking for.
I have worked and worked with him and he will not work with me. I am not a business and I still tried to make it write. Today This exchange took place. After I asked him why if he was unsure he bought a new DME.

The ECU sat in the car with all the other parts I was gathering for the swap. As I stated several messages ago the money isn't the important thing; having a working product is. There is no charity involved here; you sold me a defective product. You should fix it.
Since you obviously are not willing to accept the fact you sold a bad product, I will have to seek legal means to either recover my money or secure another product. I will also post on the forum you are unwilling to remedy the situation.
