This might be kinda of lengthy, but i need some help/advice.
Last December my M20b25 in my 87 325is died....S5X time. The motor blew on my last day home in New York for Christmas break so i obviously didn't have time to get anything done, not to mention i didnt have the money either. Then in April my E30 was still sitting in the garage New York with a blown motor my dad decided to sell the house which left me without a place to work on my car (I go to school/live in Ohio). So i started looking for an S5X and someone to do the swap since i was without a garage or time to do the work.
I found a kid (Mike) in NJ with an "running s50/all accessories" with 90k miles on it for $1500, needless to say i jumped on it. After trying to find a shop/person to do the work, Mike (the guy i bought the S50 from) said he would do the swap for me. After negotiating price and making sure he was capable i decided to accept his offer and have him do the swap.
My dad had the car towed to his place for him to begin the work. I paid him for the motor and agreed that the labor($1000)/misc parts cost would be covered upon the car being delivered to me in Ohio, something Mike said would be no problem because he has a trailer and a truck for towing.
Mike and I searched the forums for the necessary parts and had everything (e34 oil pan, throttle cable, mounts, etc...) sourced and shipped to him in about a 2 weeks. He told me he would have the car done in "5 days". At this point it was early/mid May.
A week or so after I was supposed to have my car i called to ask when I could expect the car to be done. He gave me some B.S. about needing this part or that part, and not having a trailer to tow it out with, yata yata yata...
So i let it slide, i figured i was getting a good deal and stuff doesn't always go as planned.
I then went back to NY to live with my mom/work for the summer, this made me available to go the NJ and pick up the car when it was complete so delivery was no longer an issue. So i started to call him almost daily in late May/early June to see where the hell my car was. He continued to give me one excuse after another. My dad insisted we give him the benefit of the doubt and let him finish the swap.
Fast-forward to Mid-August, I am back in Ohio and still without my e30 i was really pissed, because i would have been able to use a friends tools/garage in NY to do the swap myself over summer. I really started to get on his case about getting my my damn car. He then told me he was planning on towing it out "this weekend" (Aug 15th). So when i called to make sure he was en-route and guess what, his truck wouldn't start, so no tow. 2 weeks later and the truck is fixed, he said he was going to be bringing it out really soon. I said that was fine by me, and asked if the car was complete and running strong. He told me the car ran great and pulled hard, The only thing that wasn't done was the exhaust. I said thats fine with me as long as i get my car and its running i can sort out whatever isnt finished.
2 weeks later still no car, i begin to bug him daily with some pretty un-friendly texts/voice mails non of which were ever responded to. So finally on this past Sunday after 10 days of hearing nothing from him, Mike sends me a text basically telling me: "the car isn't running, i give up. I think its my wiring harness. Ill tow it out to you asap and all you need to do is get a harness to get it running."
WTF?! a month ago it was running strong and now he tells me it has actually never been started?
Right now my goal is to get my car and tell him that he will be compensated for the parts he bought and labor only when i get the car running. But who the fuck knows whats really wrong, are a million reasons its not starting!

Im located in Granville Ohio (30 mins East of Columbus). i really cant afford to pay anyone labor costs, but I will supply food, beer, and a place to crash if needed for anyone who can help me get my car running once it gets out here.
