    You can fight it best by mail (trial by declaration).

    In the event you don't win or you aren't happy with the results, it is your right to request a "Trial de Novo", an actual in-person court trial, where you get a second chance to fight the ticket.

    Don't dream that you can win the fight and keep all your money all the time, it doesn't always work out that way. Money can be made, but points on your record are a pain to get rid of, and it affects a bunch of other things.

    I once wrote at the end of my declaration for ticket I got going to bfest, to the court to basically 'keep the money, and do not give me a point' after proving everything the cop used to cite me was unjust (no radar, no laser, no pacing, nothing). They kept the 175, and I didn't get a point. I think they just want the money and could care less about the points.

    BTW I just got another speeding ticket which is complete bullshit, 65mph in a 55mph cause i was towing a trailer with my race car in it....so off to fight another one.

    Already extended it to July and it's my first speeding ticket so no I haven't taken traffic school. So I couldn't just request traffic school and pay the ticket by mail? Only reason I'm considering doing this really is because I got the ticket far away from home and don't want to drive 3 hours just to show up at court. Thanks for the help man!

    If you haven't had taken traffic school more than once, then I'd say bite the bullet on the price of the ticket. I got a 94 in a 65 3 years ago on the 73 toll road down to SD. I wasn't supposed to get traffic school, but the judge allowed me to do so if I paid the full amount of the fine. More likely then not the cop will show if you try to fight the ticket, especially CHP. Extend the ticket once, then go and see the judge and plead for traffic school. I've done two traffic schools in 18 months on both occasions that I asked. The second one will be 12 hour, and you have to physically sit through one.

    If you haven't taken any traffic school in the past 18 months, I'd say go straight to court and ask the judge. Unless he/she is a real dick/bitch you should get it. If this is your second speeding ticket in the past 18 months, it may be a little harder. Most judges will only allow the 12 hour traffic school if it is for an offense that is different from the prior one that you used traffic school for.

    If you have already taken both traffic schools, then I'd say extend the ticket once, then apply for TBD. If you do so, just write NOT GUILTY in the statement area of the form. If you give any kind of evidence, it will work against you if you want to file for a new trial. Stalling is always your best option, the longer you wait, the less likely a cop will remember, or show.

    BTW did the cop write any extra notes on your ticket, explaining to him what exactly happened? Sometimes they do that for future evidence in court.

    Have a 75 in a 55 I still have to clear up and it looks like I'll be taking the same route. Any advice? It was around 1AM on an empty 1 lane highway with my dad following me at the same speed (he actually got a warning for following to closely). Everyone keeps telling me to fight it by written declaration but what could I possibly argue in my favor? And can I request traffic school in the letter as well?

    I find the extend method to work nice. they usually think you will go the maximum amount of times (3) i think, and they will show up, but if you change it up and go on the second time it works.

    So how is that a bullshit speeding ticket? You were going almost double the speed limit (a felony btw), and got popped for almost 20 over. That's not bullshit, that's you being reckless.

    yea i know i was speeding, no one was around was 1am , was just coasting down a huge hill thats like 2 miles and i seen the car parkd on teh side an hit the brakes but didnt want to be burnt, soon as i passed i knew i was screwd, he was chill tho and the car wasnt even mine, was my gs's. the shitty part is that it cost so much and yeah a point. was my 1st speeding ticket ever and will be my last. lesson learnd keep urs eyes out when speeding :D

    The cops were specifically looking for BMWs. I got popped too for a front plate and smoked tail lights. When I got it signed off, the police officer said "wow that must've been a stretch for them to give you a ticket just for those things"

    Well 62 in a 45 is 17 over the limit. You clearly were speeding, so you can't get too pissed about getting caught. :-|
