    hit and runs help

    alright guys. i have been letting this whole problem soak into my brain for a few months now, and the more i think about it, the more upset i get about the WHOLE situation.

    My fiance and i moved into this apartment complex earlier this year. i used to live here a year ago when i rented a room from a friend after his roomie dodged out one day. i wasnt around long, as the lease had 2 months left. that doesnt really matter i think, but it might, you let me know.

    So the very FIRST weekend after we moved in my tail light is busted apart and someone stuck the pieces back into the housing to hide them from plain sight on the ground.

    in may the gardens to be lined with rocks. one night when i washed the car to remove pollen about 2 blocks away, i realized there was a hefty size crack. not even 12 hours after the rocks were installed, my windshield was cracked. the parking spot i had before i left was available and when i went back, a good size rock was laying by the curb. so i have it in the apartment with us.

    in april my rear bumper was hit in another hit and run of some sort but only the long strip is busted up. my car got paint transfer from another vehicle on the fender and a small dent, a few small dents throughout, and scratched to hell by god knows what.

    I moved here in February, and this area has yet to get any sort of severe weather/hail.

    now this is what i need help with. i want to get ahold of the property management directly and talk about the damages to my car. all damages to this car happened on this private property. when asked for a garage or covered parking, i was told there isnt any available. i do have liability on the car, but that shouldnt matter as all this accidents happened on their property with the tenants they allow in.

    who is responsible for repairs? i dont exactly want them to pay for a respray, as some nicks and dings where there before, but the bumper strip, tail light, windshield and half of a respray would shut me up. any advice?

      read your lease. 99.9% sure there will be a clause releasing them of any liability. I was rearended in my apartment complex by a drunk kid in an IS300 trying to piggyback me through the entrance gate. Called the cops and the cop was pretty much like, "oh well"

        Moving isnt exactly an option when i am locked into a lease, as some of you may know.

        i mean for the price we pay for living here, some video cameras to watch and record would be really freaking nice.

        so no use contacting a layer? im looking at around 5 to 7 hundred in damages... estimated.

          unless you can find the actual people who hit your car, you're pretty much SOL. The property management is most likely protected under you're contract.

            renters insurance might help.

              did you read your lease like i said?

              renters insurance covers items within the walls of the apartment, not your car. that's what car insurance is for. you could claim it, but i'm sure your deductible is about that much if not more.

              just a consultation with a lawyer will probably cost as much as your damages.

                not true... some renters insurance policies cover your vehicle while parked on the premises... I'm sure it varies from state to state as well.. Home-owners insurance covers you car while in the garage, so...

                You are wasting your time blaming the landlord, or hiring a lawyer.. this is what insurance if for. if you don't have any insurance, you pay for the repairs yourself..

                But here's a way to make yourself feel better... add up all that money you saved not buying insurance, and that should pay for the damages.

                    true, but like i said, i have liability. protects me if i cause damage to another vehicle, not the other way around.

                    Home owners insurance covers any vehicle parked within your property, i know this from a very recent accident. renters insurance only covers the actual physical property you live in, in tx.

                    did i blame the landlord? i think not. i am blaming them for lack of security, which i signed my lease as one of the terms "provided security with gated community and security throughout"

                    Also, it is against the law to not have insurance on a car in Texas. so either way i have bought insurance.

                    I was just wondering if there was a way the apartment management (no such thing as landlord in these parts) would be responsible. when i spoke to the managers manager she said she will get back to me about what she can do. still haven't heard a response. this also just isn't my car, my fiances truck, our neighbors suv, and my other neighbors jeep. it seems to be a common problem that needed to be addressed a few times before, and i think after so many incidents and management doesn't want to put up video surveillance (although they have 14 cameras watching THEIR office) they should be held responsible.

                    Hell, fuck it. being up shit creek is the irish blessing, eh.

                      dude, READ YOUR LEASE. do you have a copy of your lease?

                      I can almost guarantee you there is a clause in there detailing who is (isn't) responsible for damage to vehicles in the parking lot. every time I've rented the lease contained a clause of this nature.

                        i do. i went over it briefly before having to run out the door and didnt come across anything. at work right now.

                        im in no hurry, whats done is done. my lease is not up yet and today i made arrangements for a place elsewhere with a yard for my dogs.

                          You sure you haven't pissed anyone in your complex? Pretty sure one person caused all the damage. How nice is your car? Most people at rental complexes will hate you just cause you have a sweet ride.

                            if you've got a buddy you can sublet it to, that'd give you an option to get out of there ahead of time without paying rent in two places...
