The guy was never able to prove he was hurt, the hospital and doctor were able to show there was never anything wrong with him and he still eventually got $25,000 out of it. Not that I could have avoided any of that by talking to my insurance company right away but I could have avoided the collections mess. The majority of people are pieces of shit and it sounds like that guy you are dealing with is probably going to try and screw you over. I'm still pissed about that whole mess.paint sucks

call the cops, and or take cell phone pics, regardless if its minor or major
damge etc, and if possible, at the scene, meaning before you pull off to the side of the road, so location, condtions etc can be seen
had a work aquaintance who got rear ended , small scuff,painted bumper, ford truck he agreed with the lady that hit him, not to worry about itt, and they would work it out in person when he figured out how much time and money he had in repainting
he then went home and backed it into a tree on purpose, to make it worse as he wanted a different chrome step bumper then the white one he had
then he called his insurance company
guess it could have been worse for the lady
the guy was a jerk,
shortly after he got fired for stealing from the job
lesson : if you got a cell phone , use it for more then distractions

He got it by keeping USAA in a legal loop for over 2 years, during which they were paying for me to have a lawyer. According to USAA, they wanted to teach this jackass a lesson and weren't giving him a cent... He was able to keep the BS up so long they had to just cut their losses. I was pissed but at the same time, they only cover payouts up to $25,000 and anything over would have been on me so it was better than him still wanting the $40,000. He was an insurance adjuster so he knew exactly what to do in order to keep it going. Oh, and he was representing himself so it cost him nothing but his worthless time to do all of this.sigpic

U know it is actually illegal to not call the cops if you are involved in a accident... Atleast in WA you can get a hefty ticket in the mail.
And you said you were going 10mph and bumper is smashed? I'm going to call bs on that.
I don't think the guy is a "biotch" at all. If someone rear ended me in any senerio I would get as much out of it as I could. Insurance companies are there for a reason, to pay up when shit happens. Unfortunately they almost always try to get out of it.m106 1990 e30

In some townships in California, the cops won't show up/make a report unless there are injuries reported at the scene, or traffic is being blocked. I don't understand this logic, but it happened to me when I was rear-ended by someone who did not have insurance. I just took down every last bit of info I could (plate number, license number, verified phone and address) before the guy left.
I was driving my girlfriend's lifted Jeep, so the damage was just some paint scratches on the lower bumper. The grill, hood, and bumper on his stock Nissan pickup were destroyed; mostly by the Jeep's tow hitch. ;) The guy's father (driver was a teenager) paid $700 out of his pocket if we did not get insurance involved. Sounded like a deal to me.Jason

I just called the guy a bitch because i did not agree with him not calling the cops and saying he would let me or a shop i know fix it. Then filing a ticket and doing the complete opposite. However, in the end it was my fault and i was angy/frustrated at the time when i called him that.
but unfortunately you cant give someone a break these days because they try and take advantage of every situation. Like a story up there, where the lady said one of our members backed up into her, after she was at fault.
