    Totalled e30

    Affectionately called the frankenbmw - s52 installed - my wife was stopped waiting for a car to turn left in front of her (she was actually 3 cars back). Off-duty sheriff looking at the floor boards for his cell phone nails her.

    Allstate woudn't even consider fixing it. paid me 3000 bucks and I keep the car. Now I am having Strictly German fix it. Salvage title which means I will end up with a rebuilt title - but hey not sure that matters too much.

    My thought was it's easier to sell if the car is running and fixed right than hassle with parting it out.

    Anyway - they think they can fix it for between 2500 and 3000...so the worst that happens is I get my car back with that new paint job I have been wanting (they will have to paint the whole car due to the fact the front was crumpled when he pushed her into the car in front of her)

    hope to have the car back by memorial day - as I have a date with mid-ohio....

            Man that sucks. There is nothing you can do if someone runs into you like that. An officer should know better than do drive while looking at the floor. He should have waited till he got stoped at the intersecetion.

              Get the car appraised... the insurance company has to re-imburse you for the value of the car before the collision..... that is BS if they wont....
              i would write a letter to your state's insurance comissioner. Tell them what your insurance company told you, the insurance comissioner will let you know what you can do about it

                Yeah 3000 is bullshit. You are probably fucked since you most likely signed a release already but they can only go off the NADA book if it applies. I got $5000 to FIX my piece of shit.

                Progressive rules.

                  Yeah, you've got to push...but it's amazing what you can get from a wreck, especially if you're the one not at fault.

                    Slap that cop with a civil suit, contributory negligence - for the cell phone thing, = a court will be quick to set precedent on cell phones and driving for 100% fault ask fro treble damages b/c he is a cop and should know better equals triple $, and then the emotional distress kicker, supoena the cop for his insurance info find out what the policy limit is for a lawsuit and ask for that, in some states by law they can't refuse if you ask to settle with in the policy limits and they are at fault. So then trash this car forget about b/c you'll buy e46 M.

                    just some sorta maybe might be in 6months legal advice

                        Don't let the cop get away with that, just because he enforces the law doesn't mean he is above it. Definitly do something about it, get money to fully cover & then some. Doesn't seem right, best of luck.

                            Unless you got the car appraised and talked to your agent about an "agreed apon" value, the car that they are insuring is a 17-20 YO BMW shitbox, not a motorswapped car with 7-8k worth of work in it.

                            They aren't charging you the rates for a car with 2x the original HP, so they're not going to reimburse you for it either.

                            But yea, get the car back together, I'm gonna be at mid oh that weekend too.

                              I'm pretty sure there is a law that says if the accident isn't your fault and the car is totalled but not your fault, your car MUST be restored to working condition and orginal condition before the accident...

                              I know this works, and there is some law, maybe only in CA tho.

                              But maybe you should ask a friend that does insurance stuff.
                              Your insurance is going to say its totalled so they won't have to dish out all the money to fix your car to orginal condition before the accident... I think if they don't do it you can sue them for not fixing your car.

                              Threaten to sue the sherriff's insurance company if they don't fix your car to orginal condition.

                              Hope this helps... Ask a insurance friend that will tell you the truth about the law or something.
