Not trying to be flippant, but the judge is going to wonder why a guy in a caravan of 15+ kid import drivers cooked it coming into a stop sign with traffic and nailed the guy in front of him hard.

i hate to agree with charlie because well hes charlie but any judge that looks at this is going to hang him out to dry. weve all been in a caravan situation and theres nothing worse than a testosterone filled caravan.

When arguning things like traffic accidents. This kind of thing is irrelevant. The fact that there are more than 2 bimmers in one spot driving together does not mean the other guy didnt make a mistake. Judges are quite capable of thinking in terms of simple actions and things like that. Technically, the fact thjat he was in a caravan means nothing at all. Now if the judge wants to have that be an issue, of course its up to him, but it shouldnt at all. This kind of stuff is equal to circumstantial evidence, it basically certifies nothing concrete. It invites useless speculation and usually judges are smart enough to avoid that. Just sharing my experiences, Im no lawyer. I hope I have helped. :)

He refused to yeild the right of way while going atleast 10 UNDER the speed limit, Then he slowed down and began to motion like he wanted clavin to pass, then he stopped abrubtly way short of the stop sign, leavin clavin to slam on his breaks while mergin back in due to oncoming traffic. Like i said there was a strange set of circumstances.

Did the driver testify to any of this at the scene? (Doesn't sound like it)

If not, it's gonna be a young kid in a hopped up BMW with out of state plates who was out speeding around with a bunch of his buddies trying to convince a judge that that good ol' boy in his SUV should have "yielded the right of way" on a 2 lane road who was then rear ended at a stop sign.

As I said, he's toast.

I dont know about the judges up there, but all that other extracurricular shit (out of state, driving nice car, more than one of the same car in one area) has very little weight here. I have fought tickets and even though at first I thought that they would take all that meaningless shit into account, I learned that it is quite often "stick to the facts and what you can prove", namely all the shit that "sets the backstory" doesnt mean crap (this has been my friend and my foe at times). Again, Im speaking about the particular SoCal judges and courts and attourneys and D.A.'s I have dealt with. This extends to non-traffic "violations" as well. But maybe they do that here because our jails and prisons are overflowing in a grotesque manner and they do the conjecture for people charged with serious crimes. Just trying to help. Who knows if Clavin even gives 3 shits what is being said here, in that case all this being moot anyways. If the judges up ther are so ignorant, then yes hes fucked, but I doubt its as bad as one would think. When you get into the system (as I have many a time) you see that its sometimes not as bad or prejudiced as what you are led to believe. In some cases, though, I was horribly wrong, but not with judges. Again, IN MY case. :)

First off some people need to get some things straight. IT WAS NOT AT A STOP SIGN OR STOP LIGHT!!

Secondly, I have spoken with the court clerk about what happened and about the judge. I am not too worried about the attitude of the judge. Also, how does the judge know it was a caravan of kids in hopped up imports? If the Cop wrote it like that, then he wasn't doing his job correctly by trying to assess the truth.

Thank you to you guys who have constructive things to say, even if they are not in my favor. For you people who are pulling facts and ideas out of your asses, well that's just fine I guess but don't make everyone else smell your hands cause it's just a bunch of shit.

I have my witnesses and expert opinions in the matter and the letter has already been sent to the judge as of Wednesday. Let's get back to the "hey clay, hope your car is doing better, see you in August bro!" kinda stuff, it makes me feel better :D
