    I did this about a couple months ago. Officer said 80 in a 65. Sent my written declaration, officer didn't send his side, so I won and they sent my money back. I was super stoked.

    I'm not from cali, and even I know that the posted speed is what THEY deem as the maximum reasonable and prudent speed based on perfect road conditions, and is not a subjective sign...

    well i have not given them any counterargument as of yet. fatigue maybe, but lack of light no. it was a very well lit piece of high way, and the lights on a 2007 mini s are not dim.

    I think that "1AM" thing totally raped your argument of safe for conditions. Fatigue, and lack of light are an argument against you there.

    well you guys are not very encouraging but i am going to try anyways.
    i did a bunch of reading and sent off my letter. i am now waiting on the reply from the court. we will see what happens. i am keeping my fingers crossed.

    I had a Sonoma County judge tell me that officers go through training to determine a cars speed just by looking at it, and they have to be within 5mph+/- every time. Basically she told me the cops word is just as good as radar. It's bullshit, but who's side is the judge going to take, their colleagues or some guy going 70mph in a 45 at one in the morning trying to argue that it was safe.

    x2. I was on that shit for three days just reading about what the real laws are and what rights and stuff citizens aren't aware they have. Made me a lot knowledgeable about what you can do to get out of most tickets.
    don't go to court, declare a trial by declaration with a check of the amount due on the ticket, your account of what happened and mail it in. You'll find templates on the website and you just tweak it to suit your specific case and voila.
