    Fighting an insurance company

    Hey guys Im looking for help on how to fight this insurance company that decided to deny liability when their construction crew left a cone in the middle of the road. Heres the full story



    Any help would be greatly appreciated :(

      I would except I'm a broke ass college student. If I could afford a lawyer I wouldn't be worked up over a smashed valence/lip. I wasn't even going to hassle them over the damage to the steering rack.

        just keep fighting, it's what insurance companies do drag shit along. been dealing with one for 2 month now over replacing convertible top cuz some ass hat cut it. they ried to total my car and give check from 1800, I lol'd in their face and got a quote to replace top best quality for 1300 and gave the number to them. waiting to here back. They are such shady fuckers.

          The thing is though, I'm dealing with a construction company's insurance provider and they pretty much said based off the situation they cannot take liability. I've never had to deal with this kind of thing before and dont know how I fight that...

            Not worth it, buy new valence, proceed with life.

              caltrans

              time for you to make a big boy decision. you could take caltrans to small claims court or suck it up.

              you dont need an attorney. when i sued caltrans for similar incident, it was like $45 to file a small claims case. i had estimates the lowest of which was $1600. pretty good ratio. i did win.

              if you haven't already, write down everything that happened as you remember it. the names of the people you talked to, when you the conversation took place and all evidence like photos. in 1996 i was able to subpeona highway patrol records to prove my point; try to get a statement from the crew what dropped the cone in front of you.

              if all this sounds/feels like a waste of time to you, give up. you're hosed.

                You don't, They'll just take you to court and say you were driving too fast for the situation. If you weren't traveling as fast, you could've avoided it.

                OR they'll say you were driving too close to the workers.

                OR they'll question if you didn't just ram it to get a new valence.

                No matter what, you don't have a dashcam, and it's your word vs theirs. All you have is photo's of the aftermath and no other records. Buy a new valence and carry on.

                    You're in college? I know that in at my school they provided free legal services.

                    Might want to check if yours does the same.

                      Small Claims

                      As mentioned above, small claims court is your best option. The ins. co. is limited to what they can spend on lawyers, and you absolutely don't need one. It's worth it for the nominal filing fee.

                        Bullshit.

                        Take them to court, I was just rewarded a little over $1,000 (including reimbursement for court fees) for a $27.95 turn signal light on my 7 series. The court system works, fuck insurance. He has more than sufficient evidence, and to be honest-when the company is served by the Sheriff's department/process server they will 100% want to settle out of court.
