Trial results

My reckless driving trial was today (see http://www.r3vlimited.com/phpBB2/viewtopic.php?t=2117 for the details) and I showed up promptly at 9 AM. Waited about an hour for my case to be called, and when it did the DA requested a continuance (an extension) until the middle of March. Why? Their star witness (the cop) was too busy moving to come to court so they weren't ready. The judge granted the continuance and now I have to wait another 60 days.

Interestingly, the case right before mine was a misdemeanor exhibition of speed (drag racing, peeling out, etc) which is a 2 point offense and punshable by 90 days jail and/or a $1,000 fine. The DA in that case lowered the offense to speeding (which the DA in my case absolutely refused to do) and the defendent pleaded guilty. The punishment? The judge gave him a $25 fine and told him to have a nice day.

Some people are really lucky.

Thanks guys. Yeah Kris, I already have one. We were ready to go on Monday morning but the prosecution wasn't. I'm actually hoping that the cop does another no-show next time because if he does, the statute of limitations will expire (since I chose not to waive time for speedy trial) and the case will be dismissed. I'll keep my fingers crossed.

I'm sorry Fred. Words cannot describe my anger. I think we can all learn a lesson from this though, if a cops ever writes down a false account of the situation, do not sign the ticket. Better to spend a few hours in a holding cell then face 90 days in jail.

I think everything will work out for you.

If not I'll load up the trunk with some "hardware" and tell the pigs to forgetabotit

Yeah man, it's a lesson learned: Don't drive flashy cars in San Jose. I've gotten pulled over twice in my Mercedes (for bullshit) and each time the cop let me go after taking pity on me and the car. I think I'll leave the E30 mostly garaged once I get it back.
