It depends. Usually, if a person is backing out of a parking spot, they have right of way. At the same time, you cannot just assume right of way and back out without making sure the area is clear. By the looks of it, the Chevy may have been stopped and you may have backed up into their car but, I was not there to see it so I can't say. If you felt a jolt when you collided, he may have been moving forward and bumped you. I would definitely not admit fault and get insurance involved. You could easily be paying for an accident you didn't cause.

I once took an cop to court when i got in an accident with an ambulance. even though I had pulled left out of a parking lot, crossed two lanes of traffic and directly across the path of the ambulance who wasn't running lights or siren, I proved to the court that of the ambulance had kept his course and not locked his brakes then the accident would never have happened.
if she takes it to court it will be small claims and you have just as much of a chance of winning as she has. both times I went to court in small claims I won my case.
#3 I agree that it's the cop's job to gather data, but the fault is determined based on that data. next time have the cops come to record the accident. whether or not you get the insurance involved has nothing to do with calling the police.

Chevy Cavaliers are possibly the shittiest car every made. There should be punitive damage and all Cavaliers and their drivers should be scrapped.
I was hit in a parking lot once in high school. The girl straight backed into my parked car while I was walking towards it with my girl friend. Her mom was a complete ass hat and called me and cried, and said they don't have money, and can't afford high insurance rates, single mom, blah blah blah. I had to talk directly to her insurance company which didn't fight me and just wrote me a cheque.

the print out the pics of the location and do a diagram. show the small claims court. i'm betting they will find him at fault since he was traveling forward and did not yield the lane to you. at most you would be a 1/2 fault and only need to pay 1/2 the repair bill.
tell her you wont pay a penny until she takes you to court, since you believe you were at no fault. ask an officer who was at fault, everyone has a friend that is a cop.
