ticket and traffic school

this is in ca. i got a ticket for rolling pass a stop sign. i called for an extension. can i still go fight the case? because when i called for the extension i wasnt given a time to be there just a new date. and if i fight it and lose will i still be able to do traffic school? because the other time i recieved a ticket i just paid the fine but i remember that i had to finish traffic school and bring the certificate with me when i went to pay the fine.

When you fight a ticket ,you plead not guilty, therefore giving up your right to traffic school. But if you fight the ticket by mail, you can always ask for a bail reduction and traffic school if the case isnt ruled in your favor. Plus you have tons more chances for various reasons in beating the ticket by mail.

What do you mean by that, more chances for the red tape of the court system to screw itself out of giving you a ticket? I didn't know you could fight a ticket through the mail.

can you fight it through the mail in san diego county? it doesnt say anything about it in the court papers they sent me.

well i guess i will have to go fight it and see what happens because i just got pulled over yesterday. so i have 2 tickets within 2 months when for the past 6 years i was averaging a ticket for every 2.5 years. i think i pissed someone off.

well what are the chances of me winning a failure to make a complete stop. because i was at a 4 way intersection going south then istopped behind the line the line at about the same time as the car on my left. so i had to roll forward a little to see if there was anyone in the intersection. it was clear so i took off and thats when i cop came around the corner and got me.

or should i do traffic school for the first violation and then pay both fines and go to level 2 traffic school. ah damnit this sucks. the bmws are going to stay home and i will drive the truck around again.

Of course they dont. Its like that on purpose. You can fight it by mail in any state. If you have a fair judge, unlike Glendale or West Covina, you have Id say a 50/50 chance. There are multiple ways to fight a no stopping ticket. And since you were at a 4 way, you have a better chance, because at a 4-way you dont have to creep up. Its cease movement, and go. If he came from around the corner there is no way he could have seen if you stopped behind the line since most lines are painted behind the sidewalk of the crossing street, even if he did its up to him to prove it. He wont get paid overtime for writing his version of the actions in HIS statement and he also wont remember you of all the tickets he wrote without seeing your face. Plus if he doesnt write anything to the judge, you automatically win even if you just write "Im not guilty" on your paper. Pigs abuse the bend the rules to give tickets more often than not, because people (stupid us) trust that what they are saying is correct. You should see the amount of ways they write wrong tickets. Did you also know there is NO 3 second rule? Its a complete myth. I got my brother off 2 of those tickets since no where in the CVC does it say 3 seconds. Just "any cessation of movement" which can mean many things. Once you really get into your rights and the vehicle codes, you really see how to defend yourself. Most people dont have the time, they just wanna go and pay their fine, thats the the city counts on. Your ignorance. ;) This is just a taste.

whatever they tell you, its your right. Ive been to some court clerks that didnt know shit and will tell you they dont know shit. You will hae to go pick up the form, though. Its called a "Trial By Written Declaration" Thats what you ask for.

You will have to surrender your bail on the sport in some cases, but if you win, they return it to you.

No - you dont have that right. In fact, in most places it is just the opposite - if you want to fight it, you have to appear.

Id question that intensely, Dave. They give you that impression unless you KNOW they do that. I know in Cali they dont ever mention it due to obvious reasons. Its more convenient, and you have a much better chance. Seeing as the pig gets paid lots extra to appear in court (In Cali anyways). Im not trying to fuck with you, Im just making sure that what youre saying isnt from indoctrination and is from fact. :) Of course I could be wrong.

Mariano, I got my law degree in 1994. I was licensed in Ohio that year, Kentucky in 1995, and am licensed in several Federal Courts, and have appeared as co-counsel in matters in several other states. I think I know what I am talking about. ;) I have heard about the Cali system on these and as much as I think it is a good system, most jurisdictions do not have such a system. There may be some others that do, but most would prefer to make it a hassle as it gives people a disincentive to contest tickets, which of course means more revenue.
