my girlfreind passed a stopping school bus

Ok so yesterday my girlfreind passed a school bus that was preparing to stop, it wasn't actually stopped and its arm was not out, The bus driver or someone else on the bus took down her info. She got a call today from a cop saying she is having her license revoked for 60 days, getting 5 points on her license and a hefty fine. Now I thought you couldn't get in trouble until the bus was stopped red lights flashing and the arm out? Is she pretty much screwed or is there no reason she should be getting all this crap?

AFAIK if the red lights are flashing, then it doesn't matter whether the bus is stopped yet or not. Lights= stop

Write down what happened and any witnesses/passengers while its still fresh. I know that at least in MA if you challenger it, whoever submitted the complaint will have to show in court and testify against her in order for the ticket to be upheld, just as any cop would, so fight it and see if they even show at least. Goodluck.

pretty sure the yellow lights were flashing at the time, not the red ones. I wasn't with her at the time, she just told me what happened I said I would get any useful info I could for her :?

So...all she has to do is schedule it for when the busses are taking the little kiddies home

Yellow lights is legal around here, its the red you are in trouble for. The guy in my hood waves me by when he has his yellows on and doesnt high the reds until I am by.

The busdriver was ragging and I would not accept a liscence suspension without a fight.

If it's bus driver's word versus your girlfriend, she's toast. The justice system doesn't work (unless you have a lot of money).

Doesn't hurt to try. 60 days is a frickin long time... My friend lost his license for 30 days, cause he got two tickets before he was 17, and that felt like forever..

and it doesn't help that she's 16 and has only had her license for a month :?

In IL it is a similar situation... If you pass a stopped school bus, the driver can report you, and the police will come knocking on your door.

I understand that the law was created with safety in mind. But ultimately its your word vs. the bus driver's.
