    12 pt ticket.

    Well I got a 12 pt ticket last wensday for a speed contest. I was not racing. And was only doin bout 15 over. With a friend we were not racing. Just would like some tips on this situation I have obtained a great lawyer heres a link to him. http://www.burnsfigawill.com/bios_new/bio-Norton.htm

    Any help would be appreciated.

    I spent a lil over a grand on my lawyer on my bump in the road with the law.

    I wish you luck on this one and he seems like a very good lawyer.

      This same situation happened to me last year. I was cruising next to my friend doing about the speed limit, and we see blue and red flying up. My friend takes the exit, i get pulled over, and he said we were racing. He said he "heard" our engines "racing" from an overpass and jumped on the freeway. He had no speed detection, no pace (though you do not need that for speed contest). in the end, the procecuting attorney dropped it to a 10 over speeding.. i should have fought it all the way. I highly suggest you fight it, and would recommend a lawyer. What are the penalties in your state? Is it considered reckless driving?

        A 12pt ticket would probably get your license suspensed....

                I know how ya feel. I had to shell out $2,500 for my lawyer to fight a misdemeanor reckless driving when all I was doing is speeding. Based on my experience, here's what's going to happen:

                1.) Cop files a report, and based on what he writes the DA decides whether to prosecute or not. (As a side note, the cop can falsify the report, as he did in my case, to make you look really bad and nobody can stop him unless you have witnesses proving otherwise.)

                2.) If DA decides to prosecute, then during the pretrial hearing he informs the judge of that decision. One of two things will happen, either he will go for the maximum penalty allowed or he will ask for a lesser one. For instance, if the law states that the max penalty is 6 months jail, 12 points, and a $5,000 fine, he may just ask for the 12 points and 25 hours of community service. Usually that's what happens since nobody wants to tie up the courts for something as trivial as this, unless you live in California.

                3.) If you agree to the lesser penalty, then you take the punishment (whatever it is) and the case ends when you complete the sentence. If you do not agree with the DA's offer, then you have the right to go to a jury trial.

                4.) If you go to a jury trial, it usually takes 2 days (one to select a jury and another for trial/deliberation). If the jury decides not guilty then you walk away free (except the large hole in your wallet from having a lawyer). If they decide you're guilty, then the judge will had down the punishment, and from there, it can be the maximum allowed by law or whatever he thinks is best. The entire process may take as long as 6 months if the DA or your lawyer ask for a continuance (extension).

                  shit, thats gay, in Ohio vehicular homicide is only 6pts, and its also tied with racing at 6pts. if you get 12, your out.

                    So you could, in theory, race someone and then run over them with your car, and you'd barely lose your license? :stupid:

                    Or run over two people. :twisted:
