Definitely sucks but atleast she's still running. Guy at the collision place basically guaranteed me that they would total it unless I worked something out with the girl or something...her car only got scratched too

ahhh. bummer man. when i got hit day after christmas last year, after talking with insurance, i got about 2k and got to keep the car. hope you had it towed home rather than the tow yard! explain how some parts you have on there are rare and you've spent time lots of time and money on this. do whatever you can to get every last cent out of them. sucks man, good luck with the insurance though.

Yea I just spoke to her and told her the quote amount and she was like "it was only a bump, and a broken taillight.." Well, hmm frame damage and bodywork on a UNIBODY car do not come cheap...arghh :hitler:

Story of my life.... I "totalled" my 325 twice with the same amount of damage.... ghey. Also yeah, the people who hit me also just had some basic paint scuffs that could be buffed out but no bending of sheet metal or paint damage. Thank Christ Ive nver had any problems in my ///M3.
After seeing your m3 at bimmerfest if someone did something that foolish they would have to get fucked up by somebody simply on principle! Well, we shall see what happens tho. I'm looking forward to what her mom says and whether they decide to settle without involving insurance.

Your car stood out to me in the Bfest pic thread, it reminds me so much of my graphite car (as wierd as that may sound) how is sat for years before its revamp. Just low and wheels. I had saved every pic and then read about the accident.
Hope it all pans out for you.

But one of them was an older lady who was having an issue with the shock of the situation and I had to swallow my propensity for violence in that instance. I jumped out of my car for that one. The elderly, women, and children should be spared from physical violence at all costs. But if youre being a douche and youre a dude.... put em up and handle yours.
total the car buy it off your insurance sue her for negligence and get the same amount of money including labor costs loss of transportation etc etc and then fix the car or buy a new one.
its super shitty to do that but its super shittier that she was on her phone not paying attention. those types of consequences are completely forseable. if she wasnt on the phone she wouldve been paying attention and would not have hit your car.
edit: she may be able to knock the amount lower through the insurance if the lawyer knows you have euro spec bumpers. since your car would have had a different bumper originally which would have prevented the extense of the damage. and might want to factor in if your car is lower than the legal limit. just an FYI.

That is a lengthy but possible course of action. As for the euro bumpers they have a federalization bar in the back which I believe was put there because imported cars must comply with US crash safety requirements.. (I'm just being logical here, no real proof this is why the federalization bar was welded in) Heightwise I can spin it all the way to whatever is considered legal height when the adjuster comes out ;)
Couple items that sometimes help in situations like this.
a) lots of paperwork / receipts to have on your side
b) stated value or agreed value coverage
c) if your insurance and the person who hit you isn't one and the same, let your insurance company deal with the other insurance company
d) the longer you can wait and "fight" the better you come out in the end
e) start looking/saving examples of similar cars etc
