    trouble with authority

    prepare for long story.

    soo it seems my brother had a run in with police last night. while coming home late at night, like around 2:00am-ish he decides to stop by a 24hr CVS pharmacy to pick up some stuff. the CVS is right up my street, less than half a mile. he gets home, parks his car and out of no where, a cop starts flashing his lights. he gets out and says my brother did a burn out at the CVS parking lot, and then says he was clocked speeding at 40 MPH in a residential street (our street). he proceeds to give my brother sobriety test, my brother tells him "before i start, im gonna tell you im very nervous because if my parents wake up they i can get in big trouble, and they might get the wrong idea and get pissed." cop says OK whatever. my brother does the test very calmly and from what he told me he passed them, since he was not drunk just nervous. the cop decides to take him to jail where he is held for a few hours. the cop ends up calling it DUI. my mom goes to pick him up.

    to prove he didnt do any of those things(atleast the burnout), he takes my mom to the cvs parking lot and they look around, no skidmarks. he said he was pretty sure he wasnt doing 40mph, he drives a e36 325is and its a bit on the louder side but nothing annoying, just good aftermarket exhaust. and the fact that the cop waited till he was home, with the car off, outside of the car to actually "pull him over" sounds a bit fishy. can they even do that?

    he woke me up at 4am to tell me this and all i did was respond with a "cool story bro."

    cliff notes:
    1.bro comes home late.

    2.stops by local CVS to pick stuff up

    3.gets home parks car, walks out.

    4.cop flashes flashes lights accuses my bro of speeding (unlikley) and doing burnouts at CVS

    5.cop does sobriety test on my sober but nervous bro.

    6.cop locks bro up, says its DUI

    7.no skid marks at CVS, bro "passed" sobriety test

        Your brother might have been drinking. Just one alternative.
        Good luck fighting it in court, you have a chance! If they didn't use a breathalyzer.

          very true, he mightve been drinking but they didnt use a breathalyzer and when the cop "pulled him over"(?) he wasnt driving he was out of the car, keys were out of the ignition. that plus the fact that there is no proof that he did a burn out, and it seems unlikely that the cop was posted at a private street that is not known for speedy drivers, at 2 in the morning, clocking the cars that go by that night. i think he can beat it

            Its too bad your brother didnt take a breathalyzer. Had he of done so they really have no authority to take him in. Atleast thats what happened to me.

            -Failed Eye test
            -Unable to walk a straight line
            Immediatly put into back of squad car
            -Blew for a breathalyzer
            Continued on my marry way.

              So, did he refuse a breathalyzer?

              90% of people on the road at 2am are gonna have alcohol in their system. Refusing a breath test is pretty much instant drunk tank in most places.

                Without a breathalyzer, theres no real proof of drunk driving. Wont hold up in court.
                Ive known people to get pulled over in their driveway over wild accusations before and it was usually bullshit. Hate to say it, but also usually racial profiling or profiling of some sort based on skin color, type of car, male, etc..

                  Seems kind of spotty. They wouldn't book him for it if he didn't blow into a breathalyzer. If he never did and they still booked him for that, it seems like a pretty cut and dry thrown out of court case. Unless of course he refused the breathalyzer, that is a no brainer your going to jail.

                    again i only know what he told me since i wasnt there but i think what happened with that particular scenario is that he was not offered the breathalyzer, in his mind he was thinking "well let me pass these test and get inside to go to sleep and never hear about it again" but when the office did in fact lock him up he was too panicked and nervous to even think about the breathalyzer test. so yeah. what really perplexed me is that stuff i said before, is it legal to get sent to jail for those charges without proof and far after the incidents occurred?

                            FYI. Cops are writing everyone tickets for jackshit. If they don't generate income they will not get their pensions, or get laid off. It has nothing to do with public safety. It's basically armed robbery. Go to court for everything and fight it!
