iPhone 4 Issue

Im just trying to figure out if my new phoned is f***ed or if im doing something wrong. So what im trying to work out is if the button on the side is the only way to switch the phone from silent and loud? Cause i cant seem to get the phone to ring loud it only just vibrates and the ringer volume is set to max.
Does anyone know how to fix this or if its a common issue?

Take it to apple.
The switch is on silent when the orange is showing, and will vibrate only.
When the switch is off (not silent-mode), make sure your volume is up for your ringtone.
In Settings there's a "Sounds" tab to adjust the volume, ringtone, vibrate, notificatin sounds, etc..

Yea the switch is off but it still says silent in the sounds settings, and the volume is all the way up :???:
Yea il take it back to the shop tomorrow, shame though i only had it for a day.

I'm assuming you have shut down the phone and restarted along with updated it. My Iphone hates putting on new music, its annoying.

and yea i updated it a restarted it but i think it just didnt work from the start so il take it back to the shop

yea it does, i made an appointment at the apple shop so il take it in tomorrow and they should swap it over.
