I'm pretty sure the Mayans calendar didn't directly say December the 21, the year 2012. I'm pretty sure their calendar has its own date that falls on that day. I say the one whom wears no pants failed.

Their year was 365.25 days, .25 x 4 = 1 day every 4 years.
The leap year isn't a modern idea, we just don't have a different way of compensating those 6 hours each year.

You can't change how long a year is, the only thing a calendar does is set a number for "the beginning". Question is, should we regard the fairy tale about Jesus as the "start point"? Even the Maya had a year one, but for unknown reasons, they also dated their calendar back thousands of years.

Seeing as how the Mayan Elders themselves have stated essentially that, "no, the calendar doesn't indicate the end of the world in a physical sense, but more of a metaphysical change", I'd say either way, you're still gonna be paying taxes for a long, long, time.
