    screwed by dealership - need advice - non BMW

    So my mom and step dad have been going to a dealership (that gets cars from auction and sells them) for their cars for years, step dad bought several BMWs, and trucks, mom bought a 4runner and brought them 10+ customers. I had no luck with my e30s, always fucking up so I wanted a reliable car for my fiance and i to get around in with no worries (m50 in my e30 blew up when me and her got into it to leave one day, sounded like a .22 bullet went off and smoke everywhere. scared her, so thats why i went reliability over style). I bought a 2006 scion tc from them late august of 2011. A buddy, fiance and I went to a dealership yesterday and test drove a brand new 2011 mistubishi lancer ralli art (left over stock) with 180 miles on it from test drives. With the intent of trading my scion and her jeep, we went in and did paper work. they looked at my car, test drove it and ran auto check. auto check says there are 2 accidents on record, 1 showed up on the carfax I ran on it a few months after i bought it which was just a side swipe on the right front, no big deal. The second accident was not on carfax but was on auto check. States in BOLD letters "AUTO AUCTION ANNOUNCED UNI-BODY DAMAGE", I was never told it had damage like that when car was purchased. Legally they don't even have to tell me that there was possible frame damage because they are not a new car dealer. So I am stuck in a huge fucking pickle. I have been paying 221 dollars a month since august for this car. Let me give a run down of pricing.

    2006 scion tc - $8,700
    3 year warranty that covers EVERYTHING - $1,800
    Total = $10,500 + taxes, plates all that good shit and interest was about $11,400.

    I owe about $10,000 dollars on everything. My ordeal is the guy is willing to buy back my car for $7,000 dollars, which is obviously $1,700 less than what I paid for it. My car has ZERO issues, everything works as it should, no mechanical issues besides a bad strut mount in the rear. Cosmetically there are a few tiny dings and faint scratches. It doesn't look bad at all. There is a 2005 scion tc on their lot with 10,000 more miles, 1 touch windows don't work, you have to hold the button til they go all the way down, rear end has a crazy rattle, rear bumper was in an accident and folded a little where there is a 7 inch long pinch, another 4 inch and a littler one. front valance/bumper has a foot long crack/broken, car drains the battery, lime green mirrors, interior trim painted lime green, basically this car is destroyed for $8,600 dollars. I guarantee he is going to list my car for $9,000 or more, and he doesn't feel responsible for the car but yet willing to pay $7,000. I must keep peace with him because my mom is an insurance agent and he will bring her customers (so she can get commission). I don't know how to get him to raise his price, and so confused on what the fuck to do. I just want out of this car because now I feel unsafe in it, as well as my fiance. I'm going off on a tangent and probably not making sense, so if you're confused, just ask a question and I will answer it, I could really use the help on what to do with this situation.

          i would definitely take the 7000 from him and call it a wash. you will get ripped off if you try and trade that in. selling it private party is probably going to take too long.

            Yup, he is the one who buys the cars from the auctions, I deal with him directly, no one else.

            If you get your head out of your ass you'd understand my issue. I'd keep the car if it didn't have some crazy damage that was hidden from me. A car was sold to me with a known BIG problem (known by dealer - not me) don't you think I should get something more than $7,000? If he gives me $7,500-$8,000 I will be happy and eat the other $2,000.

              What the fuck is this shit? Do you understand vehicles depreciate over time? If your that pissed about it don't sell it to the dealer. Sell it to a third party instead and probably get more then the dealer is offering you. The dealer has to make money. They are going to sell your car for more then they're paying you, get over it.

              Dealer didn't tell you about damage. Is it fucked up, yes. But what are you going to do about it now? Go back to the dealer and demand your money back plus the warranty?

              It's not the dealers problem YOU bought a vehicle with unibody damage. Why should they pay more for a car with unibody damage?

                I don't have $3,000 dollars laying around to just pay it off. If I had $3,000 dollars laying around, honestly I'd probably just say fuck it pay it all off and have $220 a month extra. I am a roofer and been losing hours because of the rain, I am behind on bills because of it, getting rid of this car is going to help me pay off my other bills faster, as well as find a new job.

                No shit sherlock, I know they depreciate, when someone sells you an unsafe car, and they don't tell you and you find out later, don't you think they should be held accountable? I am not asking for all of my money back, he made money off the original deal, why couldn't he give me 700 less or 1000 less than what I paid, sell it for 9,000 and make profit again. It's out of respect that he sold me a car with an issue and should stand behind it.

                  Take the cash and build reliable e30. I would have never went from owning an m50 e30 outright to financing a car. Its bad enough owning a car that's going to loose value, but having to pay an interest on top of that.....Sounds light a nightmare. If you want reliability buy a early 90's accord. A well sorted m50 e30 could be very reliable. Sorry for going off on a tangent. I would be super happy he's willing to pay $7000 and take that car back.

                  edit: and is it really unsafe to drive. You've driven it a year already and hasn't exploded yet.

                    But really, I'd say that what you're being offered really isn't that bad.
                    A lot of cars depreciate like CRAZY, and that ain't half bad, considering that you were lied to/not notified of its frame damage.

                    Take a hit and drive away in the nice lancer! If you wanna make the some quick money to compensate for that, you could make a quick profit off of flipping some wheels or other parts you could pick up from a yard. Hell, maybe even a random e30 partout..

                      I would snap that deal up, seems generous to me. Next time ask more questions before buying. I assume you got the carfax and auto check on the Lancer, 180 miles is far enough to have an accident.

                        have you ever watched pawnstars? you will never get as much as it's worth from a dealer because they need to make money on it. If you sell it yourself you will always get more but you have to put in the work to get it done or just push the easy button and sell it for cheaper to the dealer.

                            in that case i would try and get rid of it by getting someone else to take responsibility and take over payments. or if its the same dealer that gave you the loan i would still take the 7k and just stop paying for it since the car is in their possession.

                              What exact evdience do you have that its unsafe? The rear quarter panel is part of the unibody. A bunged rear quarter that needed to be cut and welded would be unibody damage.

                              Just becase there is unibody damage doesnt mean the wheels are going to fall off at any moment.
