Need some advice

Alright, so currently im in a situation that i have no idea of what to do.

First started off when i sold my old phone to this dude about 2 weeks ago, met him at Walmart, showed him the phone and he was down to buy it. Few mins later I said ok $160 for it, he said "mehhh, can you go lower?" I didnt wanna do it but since i was lenient i dropped it for $140. Took the offer but he only gave me $100 and told me he'll give the rest the next week cuz he needed the phone. I let him have it and says "I'll give you a call when i get the rest."

As the week goes by few days later he calls, complained that the battery was shot and wouldnt boot up, I tried to troubleshoot it over the phone but i just ended telling him to meet me up at my work(which in this case IDK why i did that) so he came around, brought the phone with me and telling me it doesnt work. As soon as i held the phone, it was blazing hot, I asked him "Did you leave it under the sun?" "No" he responded, so i ended grabbing the charger and charge it back up. Since i was busy, I ended up telling him that'll have to keep it overnight so i can have more time to work on it. He's completely fine with it and I said I'd call him. Came home, and it turned out both batteries that came with the phone are in good shape and he ran the battery down to like a safe mode level, I flashed a different firmware to help speed things up and help with battery life.

Came to work next day, I called the guy up, no answer, left the voicemail saying the phone is ready to get picked up. The whole day went by and nothing. Called next day, no answer, I left no VM. Day after, called again and no answer but i left a VM saying the same thing. Waited for a whole weekend for a call back but the following Monday i left a text saying "I've been having your phone for a week and someones already giving me and offer and that person will be coming by on Wednesday." Waited till Wednesday, no call backs or response to my text.

Im irking to sell the phone because I needed the money, I have no idea what to do, he still owes me $40 and ive been waiting just about two weeks. But I dont wanna sell it behind his back and then days later calls me hes getting the phone.

What should I do in this situation? Sell it behind his back or wait another week?

Your first problem is accepting the 100. Deals like that should ONLY be accepted in full. He could have ran off with the phone for all you know. Now youre left in a situation where hes wasting your time, but you CANNOT sell it to someone else since he has already invested money into what youre selling. You cant do it behind his back because you accepted his payment.
Rather than doing it behind his back, let him know. Tell him he must show up by a certain date WITH the remainder of the money he owes you, or you will sell the phone to someone else and will return his money to him. Its his fault hes not answering your calls or texts. Thats not your problem. If he really wanted the phone, he would have been on top of this.

Considering the fact thats not the point why i made the thread, the whole reason i made this thread is because i need advice whether to sell it behind his back or not, i could really give two shits about $40 the phone itself is worth $180 but thats not what im after

Ill have to admit yes that was stupid on my part but I needed the money and he needed the phone so it was like a fair swap, cant say it is but you get the point, but i WILL remind him, I could be a total douche and charge interest but i wont

Fully understandable, and I know what youre talking about, just a waste of time but yet i want peoples second opinion on the situation, youre helping in a way but i love your seriousness in this case, I do accept that I was stupid and that was that, we all needed the money and in this case I was bit in a rushed to get it and go, and selling it for $140 ISNT a dumb deal, i consider it a fair price in my situation

I don't know you, so don't think I am labeling you as a rat. Everyone gets in a rough spot for money, it is life...but being honest when you're down and out shows you are a good person. So be honest and wait, he gave you 100 already. He will be back with the rest for his phone.

It is common sense about what you should do, the fact that you posted a thread about it shows you know it is wrong to sell it behind him.

You could sell it for 160 behind his back give him back his 100 and have to live with you knowing you fucked him over on a struck deal. IMO that is shady and dishonest. You did the deal, so ride it out and learn from it.

You informed him that someone else was interested and he had until Wednesday to come get the phone and pay. By him not even responding at all, I'd say that means he no longer wants it and you are free to sell it. Refund his money and move on.

Well, if he choses to "sell it behind his back" he now fucked himself by inviting him to his place of work. He knows where you work. That means he knows where your car is, how to fuck with you, etc.

Just tell him you have an interested buyer and a few days that he needs to make good on it.
