    Breaking A Lease? School Me on This

    To make a long story short...
    I've been living in these apartments (it's a Lincoln property) that used to be townhomes/condos
    Pretty nice up front. 2/2/2 car garage. 1108sqft. You initial thoughts upon arrival are "damn, this place is nice" but it's not and I can't wait to GTFO

    SO we checked em out and some reviews then signed a year lease. Couldn't pass on this deal. All for no more than $1150mo. Sweet!

    First month there we learn that the HVAC is terrible due to poor insulated walls and ceilings. The walls are terribly thin and what do you know you can hear everything your neighbors are doing or saying.

    Within weeks there's a double homicide on the premises. They send us all a note saying they know what happened and stay calm.
    A few weeks after that there's a series of some pretty nasty burglaries. Kicking in doors and gun points. They send in another note saying be aware of your surroundings and such and don't leave at night. Wow. ok

    Few weeks after that more burglaries and louder neighbors move in. We start getting random people following us home begging for money. A drug bust. More cops showing up. It was just becoming a mess.

    Also to note, my dishwasher hasn't worked since I moved in and we've been there 6-7 months now. The microwave broke and they replaced it with a used one that still doesn't work. they then replaced the dishwasher with a used one that doesn't drain water and leaves the entire kitchen smelling like stillborns.
    Also, I had to start parking my truck in their parking lot (we have our own driveways) which they told me I could do because my truck stuck out of the driveway by 2 inches. now their threatening to tow my shit if I don't park it in my driveway. WTF

    I'm tired of this place and their retarded staff and I'm ready to leave. I have two very young children and I'm worried about their safety as well as their mothers and my own. How can I do this without negatively-effecting my credit and rental history? I've already confronted them and they offered to move me to another side of the complex for more money and a 6mo extension to my already 12mo lease.

    Cliffs:
    Murders
    Robberies
    drugs
    cops
    bums
    I don't feel safe anymore and I want to leave!
    Terrible staff and maintenance!
    How do I get out?

    holy shit 1150 a month? Thats twice what I pay for 4.5 acres and a nearly 3000sqft house with a 3 car garage. Pack up and go find yourself a house

          Oh, well no deal lol. Care to PM me about the details? APR, PITI, Taxes?
          I'm not really into mortagages as I work mortgage and loans. I would rather rent in todays economy until I have enough saved to buy the house cash if I wanted but finance 1/3-1/2 just to keep money in the bank.

          That plus I'm not firm on where the family would like to live and what areas present the best oppourtunities. At least with renting I could just up and leave and have an impact on my rental history.

          *edit, I just drove through there on google maps. That place is gorgeous. Looks a lot like north texas.

            So you only have 5 months left, why not just wait it out and start looking for a new place now so this doesn't happen again. But I have never been in a place that shitty so it might be best to move.

              Your lease agreement will have an outline describing what will happen if you break the lease. It's all there in fine print. Break out your copy, and give it a read. 9 times out of 10 they also have a "get out early" clause, which usually involves finding someone else to sign the remainder of your lease.

              Every company/owner is different.


              That said. I'd be reading that agreement. I would want out as soon as humanly fucking possible. It isn't conducive to healthy living in any way.

                same thing happen when i lived up in sacramento. me and my wife went looking for an apartment to rent. we found one close to her college. at first the place look very nice and the staffs were very welcome until we moved in. the staffs became bitches and gates were broken. we actually had our spare tire for our newly bought crv stolen and others car were broken into. i couldn't even open my e30 hood in our parking stall. the swimming pool smell like shit. The laundry unit could use a cleaning, and the maintenance guy suck (knock on our door at 7am so he can fix one of the window screen). after our 1 year lease, we moved out right away. i will never live in an apartment again.

                i would stay the whole lease and gtfo asap right after.

                  ^ true and to sum it up it tells me that it will pretty much have a negative impact and I can be sued for the entire amount of the remaining lease.

                  However there are texas rental rights and laws that govern certain conditions which are similar to most states. For example, in texas after 60 days of the origional request for maintenance we have the right to make the repair or replacement by a certified repairman or tech and have the land lord or propertty management reimburse us fully. OR we have the right to submit a 60 days notice to leave with the full deposit returned to the leasee. However if repairs are made then that 60 days start over and they seem to only do what gets them by. Not cool at all.

                      Yes, but that is only related to the health and safety of the dwelling. The dishwasher is not part of health and safety. If you have heat, no leaks, sealing doors/windows, hot water, working stove and refrigerator and fire detectors. The health and safety is assured.

                        Well I only have one smoke detector in the entire house.
                        And based off what I read, no matter what the issue is, if it requires attention they should make an attempt to fix it within 60 days of notice. When I asked the manager about it she confirmed and got all nice and polite with me and assured it will be fixed.

                        IDK, I really would hate to stay here much longer. But I signed the contract so I'm stuck. Unless someone knows a better way???

                          What outs does the contract give? What is the lease breakage fee - there is likely to be one.

                            wait it out man, and stay safe. hide/move away your valuables and maybe find yourself a pretty girl who lives outta town and spend more time at her place.


                            that is, of course, if you value your money over your life. there's bound to be a contract breach fee and who knows what else. but money is just money, and unless that's all you care about i'd advise you to get the fuck out ASAP.

                              Thats bullshit, im sorry. I second the Move your GOOD STUFF OUT ASAP. Go to apartmentratings.com and fill out a summary on how shitty and Crappy they are.
                              They also have other places on there so next time you know where to move.

                              Can you buy a firearm? Living there by my self is one thing,but you have kids Fuck thats a hard choice.
