    AZ Lemon Law Questions

    I have a question regarding a car I recently purchased. A week ago I purchased a 2005 Infiniti from a dealer in Phoenix. I completed the purchase and began my 2 hour drive home to Flagstaff. Thirty two miles into the journey the car completely died on the highway. I called the dealer and they told me to have it towed back to the dealership that they would take care of it. I had the car towed to the dealer and had to take a cab and shuttle to get home running me about $220 total.

    They called me the next day and said the fuel sending unit had went and even though the gauge said a half tank I was actually out. They said they replaced the fuel pump and fuel sending unit that I was good to go. I took a shuttle back down to Phoenix to get my car. I filled it up and sure enough it said a half tank. I take it back to the dealer who says that they have already done more work than they had to by law and that they weren't doing anymore with the car. I contacted the manager a few days later and he said the same thing.

    So now I am out over $300 and have a car with a malfunctioning gas gauge OR they never even replaced the fuel pump/sending unit. I will be taking the back seat out to check this Saturday if they actually replaced them.

    Arizona does have a lemon law for used cars, but I am not sure if I qualify? What are my options here? I don't feel right just letting them shrug it off after I spent a decent amount of money and the car died within a half hour.

    If you bought the car "as-is", or no warranty, you have nothing to stand on.

        Ah lame. I was hoping somehow the AZ lemon law covered it. I guess negative reviews on the internet is as far as I am going to get. It's disappointing that they won't cover the $300 I am asking to cover the costs of the tow/shuttle. Especially being a higher end car dealer.

          The period covered by the Lemon Law is the term of the manufacturer’s warranty or two years or 24,000 miles, whichever is earlier. This covered period begins on the date of delivery of the vehicle to the consumer.
          Remember: Arizona does NOT have a “cooling off” period or three-day right to cancel a car sale.  


          They also state the Lemon Law pertains to New cars, not used.

            there is a 15 day 500 mile warranty on all used cars the state requires that are bought from car dealerships I have never had to deal with it so I don't know what your next move should be

              "Used cars in Arizona are sold with an implied warranty of merchantability that applies to every used car sale (although a specific defect may not be covered if it is spelled out in writing). This law is found at A.R.S. § 44-1267. The implied warranty lasts fifteen days or 500 miles, whichever comes first. The dealer must be given two opportunities to repair the vehicle, before a consumer can seek a refund."


              Implied warranty seems like pretty shaky ground to be standing on.
