the guy's insurance, the guy that caused the wreck, admitted to the cops he was speeding, and trying to cut everyone off in the rain, was issued the at fault ticket, and then dodged his insurance company until i went to his house and had him call; is trying to blame me for the wreck. they're saying that i should have been further behind the guy, and traveling at a safer speed. i was about two lengths behind the guy doing MAYBE 15 around the turn. i had enough time to cut the wheel, and pump the brakes so they didn't lock up immediately, and avoid a trailer hitch through my radiator, but it's still my fault... i'm so pissed off that i could beat the ever living shit out of the insurance guy, and the driver. i've called and left a message at my attorney's office, and hopefully i'll hear back tomorrow, because i'm not putting up with this shit. it's been well over a week, and they're just now saying it's my fault, when the police report has EVERY little detail, including the guy's admission, i honestly don't think they've even looked at it.

Financial responsibility for legal liability in accidents is a secondary function of insurance. The main function is to indemnify the collateral for loans from financial institutions. Our economy is built on that fact. You could not buy a house or new car without insurance protecting the collateral against physical loss and damage. Your description of the accident is too vague to make a determination of liability. You should live in Texas and have to deal with "contributory negligence".

I got the shaft from my insurance company last year (yay, Allstate). You can fight and fight, bitch and moan, lose sleep, get pissed and fight some more. I was out several grand I didn't have....but honestly, it's easiest just to let it go. At least that's how I've dealt with a raw deal (yay, Allstate).

Hah, I feel your pain. 6 months ago I totalled my Nissan (not at fault). October all my courts were done (the kid tried to blame me for the accident).
Today I just recieved a letter from him insurance company that they are re-investigating the case and they want to talk to me. Great... more annoyance.

The "automatically being at fault for rear ending and reversing" is retarded.
I've had a friend get screw from a car cutting infront of them and hitting them, even when the damage was clearly to the side of the car suggesting the wreck was from a car switching lanes and clipping the front. I was backing up and got into an accident, though it was my fault, the insurance company said "When you're in reverse, it's your fault".Comment

I became a contractor right after 9-11. I got a quote for contractors insurance in Aug 2001. The cost was right about $500.00 a year for me.
In Oct I got my license and went to pay for my insurance. It went up to $750.00 . I kept the insurance the next year but was asounded when I found out it went up to $1400.00 a year.
Insurance companies clump everyone together. I do about 10 installs a year. So every time I install cabinets it costs me about $140.00 just to walk into the customers house.
Insurance is bad enough, then we have the government how HATE small bussiness.

ok, here's an update. progressive didn't take the 50/50 fault split from my insurance company, but they called yesterday to offer me $600 for my car. my mom went after them, and they agreed to give me 1500 dollars and i keep the car. which is more than the 50/50 split.. i still don't have any claims filed against me, so, this is looking to be moderately decent. the 1500 WILL fix the core support, get me a hood, and fender, and then i get to fix the other problems, such as my transmission, diff, and get the other half of the wiring harness i need, then i'll probably still have ~1k left, and may just paint it.
