Wouldn't she have signed a contract with his name on it too? Tell her not to sign anything else. Then she is only on a lease with both names. At that point when they come looking for rent they have to go after both people. The contract she signed had 2 people on it. They can't change the contract and tell her she agreed to it.

It seems like if she kept paying her part of it, when they come for the rest, she could just give them his name and address and have them deal with it.

i personally dont know about her contract, but the contracts i have entered into, it never says who pays what part of rent. management does not care who pays for the rent they just care it gets to them. if she only pays 1/2 of her rent she will get evicted from her apart. and im sure she does not want that with a kid and all.
what she should do is go to her other lease holder(your friend) and go to managment and present them with her problem. im sure when they find out that they might have a problem with having them get payed, they would look in to finding a solution. because he still in on the lease so they would make him pay his share or reduce her amount(which might not happen). but im sure they wont let him get out of his lease that easily.

Hey, that's the price of signing a lease that you can't keep. Its better to eat the deposit and keep moving forward than to be on the hook for 10 months worth of rent payments because you decided to leave without paying.

One other option which might even be agreeable to the landlord is to find a tenant to take your place. I broke a lease once and they let me out of it penalty free because I was able to find someone in the military who needed a place short term and they simply transferred the lease and balance of the agreed months to the new tenant.

OK, even if there are two people in the lease, each one of them is liable for the rent unless the 50/50 division is clearly stated in the contract, on the other hand all contracts have flaws, specially because that contract had to be a standard contract modified for two signers, my advise is not to sign anything whatsoever, and get counsel.

BTW, beat the guys face for a while until he behaves like a man and pays for his half of the lease, just give her the money, 1/2 of the payment for the rest of the year, then he can go.

NOTE: Exchange rate for behaving like a total waffleswaffleswaffleswaffleswaffles and walking out of leases goes around a punch per dollar. ;)

Also I might add that the time and effort spent trying to gain recourse in this situation will cause you more greif than its worth. She would be better off applying for public assistance to have her rent supplemented. If the apartment management is worth anything, they will gladly accept a section 8 coupon.

She is being left high and dry. the apartment is shadey. trouble is if she gets out she will just ahve to find another place AND person to rent with.

If she was not so stupid I would date/bang her and she could live with me, but she would still have to pay!

Anyway. There is about two months before anything has to happen, the rent is paid for May and Adam claims he will pay for his part of June too.

they are both 19, things may change. Either way, I am glad it is not my kid, or that Erin is my girl because it is way too much stupid shat for me.
