    Again, he won't sue. Plus, if his product is so superior as he states in the quote, a little competition should be helpful to his sales. All he has to do is change advertising. People are too quick to sue these days, although being a Realtor, he may be broke due to the market. Maybe this is where it's coming from.... where does this guy live?

            Please be advised that Lukas Motors LLC maintains registered trade name (AZ Registration Number 362895) in the Lukas Motors name and mark and has intellectual property rights to the design and fabrication process of BMW performance products. Your use of the trademarked name, photographs, and duplication of the “heatshield” fabrication process is unauthorized and constitutes willful trademark infringement.

            In addition, you have admittedly used the goodwill in the Lukas Motors name to mislead consumers on eBay. Your conduct constitutes unfair business practices and false advertising.

            The policy of Lukas Motors is to send a message to those that infringe on the Lukas Motors mark or falsely advertise their products by making sure that such violations are costly for the offenders. I assume that if you had known that Lukas Motors sues over such infringements, then you would not have misused the Lukas Motors mark in this fashion. You are not the first eBay seller to be caught and sued by Lukas Motors in an effort to stop the proliferation of trademark infringement and false advertising, nor will you be the last. Each case that we pursue spreads the word a little farther that Lukas Motors has a no-tolerance policy for infringement of its marks or for unfounded performance comparison claims. Eventually, we hope that eBay sellers and other Internet users will refrain from the unlawful and infringing use of Lukas Motors mark and from making unfounded performance comparison claims.

                  I understand that Lukas Motorsports and myself have created a similar product, but to sue me over such accusations as to create a exact duplicate is insane. I believe that it is going to be pointless when you only move about 10 or so products per year.

                  While reading your fantastic legal terms, I thought to myself, I wonder if he is getting sucked off my Lukas Motorsports at this present time. I then questioned myself pertaining to who is the catcher and who is the receiver, or in this case, the fucker or the fuckee. I would like you to produce a court ordered cease and desist order, signed in triplicates, stamped, double stamped, copied, then signed again by the blood of Satan himself.

                  Here a KAMotors we also have a no-tolerance policy, and that is no-tolerance for Lukas Motorsports being a giant sack of butt fucking, salad tossing, rusty trombone giving goat fuckers to be suing me over a stupid piece of fucking plastic. So please, take your shit hole pointless heat shield turn it sideways and stick it up your candy ass as you bath yourself in the waters of Lake Minotonka.

                      Did they just send that out via email? A REAL attorney trying to get your attention would have done so with a registered return receipt requested letter on their letter head, not by a fucking email...

                      Pay an attorney $150 to write up a nasty rebutal letter and send it to all of his party's involved in this matter by the above described method ONLY for harassment and pain and suffering. I deal with attorney's DAILY and this is how they do business for the record, in case it does go to court, not by fucking email...

                      They also do not talk about how much they try to settle cases before it goes to court, thats just not how it works. All they would have done is notify you on the infringment and that further proceedings would follow. Not go straight for the pocket book on the first letter out. Plain and simple that was a fraudulent scare tactic used by him to try and gainfully aquire money or scare the shit out of you...


                      Oh and for the record that email address is not found on google AT ALL...

                      In NO means should you contact them in any way let a attorney do so for you. It will likely only cost a hours worth of their time...

                        I would also print off and keep copies of those ads for when they are deleted from EBAY's system. Just in case it is needed for proof of not using his name, images in the ad. Also supply a copy to the attorney if you do a rebutal letter to his involved parties...


                        I know he reads this thread NIGHTLY as well...
