This is a great video. Its a bit long but it covers the 5th amendment! This is the best 50 mins spent watching a video. This could keep you out of Jail!
This is long, but I will watch it all, pretty interesting.
I'm up to the part about possessing a lobster can be a federal offense.
I agree though, I never talk to cops, let them search my car, etc... Theres no point. No good can ever come of it, the only thing that can ever happen is you get screwed some way or some how. Its not beneficial at all.
Edit:
Now I just got to the top 10 reasons. Whats number 1? It can't help you
I would agree there is a lot of interesting information there. However i have been honest with cops the last 5 times i have been pulled over and have been let go each and every time. I can see how if i had gotten a cop on his period i could have been fucked though. I might just keep my fucking yap shut next time.
I'd say that there is nothing wrong with being cooperative with a cop if you have done nothing wrong but you also have to know your rights. I could see allowing a cop search your trunk if there is some immediate benefit but it's something else to allow a cop to search you because you don't know any better.
Whenever I am walking out of Walmart or Home Depot (or some other big store) and the anti-theft alarm starts to buzz, I keep walking out the door. Unless they saw me steal something, they don't have a right to detain me. If they stop me, the first thing that I ask them is whether I am under arrest. If they say "no" then I leave without further discussion regarless of how many times they yell "Sir, PLEASE COME BACK" If they persist in attempting to detain me, I threten to sue for false arrest.
I agree, outside of a traffic infraction, one should most definitely invoke the fifth a.k.a. FIF a.k.a. FIVE a.k.a. one, two, three, fo, FIF. (lol, anyone remember the Dave Chappelle skit)
One thing is for sure though, be ready to go to jail, get bailed out, retain an attorney and go through the motions.
I had a friend that got pulled over for some BS turn signal. The officers then commenced the whole, how many drinks have you had today, you smell like alcohol, let's do a field sobriety test bullshit routine. Again, remember they pulled him over for not having his signal on long enough or some bullshit; not because he had been swerving or the likes. He refused the field test and the breath test (he had indeed had a "few" drinks earlier) and stated he would no longer be answering any questions. The cops in spite of him took him to jail. After almost a full day in jail, money to bail out, $750 to an attorney and a couple of court visits, they got the case dropped.
Not talking helps but it doesn't really help you from going through the motions... If you're guilty though, it sure helps your chances. It will help the true criminals more than anyone else though, that's for sure. It's almost as if it's a right for the criminal more so than a right for the innocent, at least in the present day. Although I can see alot of minorities needing to invoke this right for damn sure. I don't know, I have mixed feelings about alot of laws.

hum Cough Cough...
I think it's more about if the cop follows the "Spirit of the law" or the "Letter of the Law" in real life. As ^myinfernalbmw^ can talk about.
As someone who wants to be a police officer I would rather be part of the respected set of officers that accept people make mistakes and need a break here and there. To be apart of the E30 and Biker worlds I am on your side and would always fight for your rights to be who you are while being safe!
but there are a lot of loop holes in the laws. And I do agree with the professor's argument.
In most cases IT CAN"T HELP YOU TO TALK TO THE POLICE.
I had a friend that got pulled over for some BS turn signal. I don't get what you think is wrong about that situation. He was pulled over and smelled of alcohol. He didn't get asked to do the tests because of his blinker, but because the cop had reason to believe that he may be intoxicated. Your friend was in the wrong from the get-go, so I'm not sure what your point is.
You should be saying: "If you're going to drink and drive, be prepared to go through the motions." Not: "If you're going to refuse the test, be prepared to go through the motions." The fact that he refused the tests had nothing to do with his arrest. In fact, only good things could have come for your friend had he taken the test. The officer already had enough to arrest him, and had he been a reasonable person and taken the test, he may have been able to prove that he was not too intoxicated. So why not take the test in that situation? If you do fail a BAC test at the scene, that evidence is not admissible in court (at least in my state). Only the real tester at the station, or a blood test is admissable evidence.
And FYI, there is absolutely no legal ramifications for refusing a field sobriety test or BAC test prior to being arrested. You can tell them to shove it up their asses. And if they have no "reasonable doubt" then they absolutely cannot arrest you. If you smell like alcohol and are a dick to a police officer, they will take you to jail; and they should. It's pretty simple.
I wish I had known a bit more about shit like this when I was younger. My attorney told me a while ago that if a person (not me because I wouldn't drive intoxicated) were to get pulled over with alcohol on their breath, that they can crack the window, give their driver's license, proof of insurance and registration to the officer and roll the window back up. Again though, if they can find any other reason to bust you when yo do something like that, they will.
