Alright I want to post this up to see what you guys think and also who you think is in the wrong as well as what you think I should do. Please don't thread shit with a stupid "you're screwed" post.
So here's the deal. In August 10th of 2007 I signed a 1 year lease for a one bedroom guest house attached by the garage to this lady's house whom I thought was a sane individual. I soon found out she was highly unstable. It started with little things like don't park your car on my part of the driveway, which was like 20ft wide, but either way I abided with no confrontation. Then it lead to things like, no people in my apartment after 10pm on week nights and 12am on weekends. Rather irritated, I complied. So time went by and the little things kept being pointed out to me by her. I have a manilla folder full of 5"x7" notes that I received from her at least 3 or 4 days out of each week and I have a Voicemail box full of 2 minute voicemails from her that came almost daily. I never missed a rent check, it was always paid in full and on time. I knew I was locked in to the year contract so I just felt with the shit and prayed for August 10th 2008. Her biggest thing she nit picked was my girlfriend. She was well aware of us having premarital sex and she, being a jahova's witness, did not approve of this. I couldn't have cared less so I just kept pushing on.
Then one day in March or 2008 I got her infamous early morning voicmail from her saying she couldn't do it anymore and that she would call off the lease agreement because she wasn't getting enough sleep because she knew what was "going on" in the apartment between my girlfriend and I. So very excited I started looking so a new apartment.
Because I work quickly I found another apartment and put the deposit down on the place and set up a move in date. I was putting some stuff in my car one day and she approached me and said she didn't want me to move out right away and that she had a date planned FOR ME to move out. Since I had. Already started moving all my stuff out I continued to over the days of April 8th, 9th, and 10th. Knowing I was going to take a few extra days to get the place cleaned up and get the rest of my stuff out of there, I made out 4 separate checks for a daily rent check for the extra days that I was there past the 30 days that the previous rent check had paid for. I thought that since she wanted me out, she would do her part to find someone to rent the place to in the month between when she called and when she started to see me packing up and loading my stuff. But she hadn't. So now its my fault for funding a place too quickly.
So anyway I continued to move since I wasn't about to pay 1100 to her for another month on top of the 500 deposit I had just out down on the new place. Each day that I still had stuff inside and was finishing up cleaning, I put a check at her door in her message box. Each check was for $35.50.
I continued moving out and in to my new place. I left her apartment SPOTLESS. I got the carpets steam cleaned and made the place look like new.
A few months later, I get a letter in the mail from her saying she has contacted her attorney and will press charges if I don't pay the rent through August 10th 2008 and for the "damages" I caused to the apartment. I talked with my attorney and he suggested I sit on it and not comply with her advances. So that's what I did. August rolls around and I get this huge envelope with like 25 receipts in it. The receipts ranged from carpet cleaning, which was already done, to other things like replacing the counter tops which were in no way in bad shape. Rather nice actually.
This time I talked to my attorney and he suggested I send her a notarized letter denying her claims, refusing to pay and as well state a claim of my own which entitled me getting my deposit back and her dropping the charges.
I heard nothing for two months until today. She called me and left a Voicemail that was once again, 2 minutes long. She once again stated she wants the rent paid through August 10th and she wants the "damages" covered as well. She wrapped up her second message by saying, "if we take this to court you will lose and you will have to pay your own attorney fees as well as mine and I will take $100 payments until the whole sum is paid for".
Anyway, I haven't called her back yet because quite frankly, I don't know what to say or do.
I know it was a long post but can some people shed some light on this subject and make some suggestions??
