Even more, the uselessness of the roadblocks is illustrated by the fact that they keep saying "Just say you're a US citizen and we'll let you go". Right, like illegal aliens wouldn't just lie. Or make a ruckus like that until they let you go.
It's poor logic but you could say that because they just let the guy go and didn't arrest him, they never had the right to detain him in the first place. In any case the process is clearly flawed.

I've been through border crossings... this is the the routine that I dealt with. Answer yes sir, no sir, and you're on your way. I had friends who got grilled heading back from Canada - they get detained and had their car searched as a "random search". They had nothing in the car that was illegal, all paperwork in order, etc. They said that though the guys were serious about their job, at the end of the day they were thankful because if they got grilled like that imagine what someone shady goes through.
I really don't see what the problem is here. If you're not breaking the laws then you don't have anything to worry about. Furthermore, if you're traveling 40 miles from the border with Mexico where a large amount of bad shit takes places, you should expect some shit like this.
This kind of thing DOES happen on main street in some places. Think about DUI road blocks, traffic stings, stopping cars with out of state plates at a check point, etc. These things aren't there to stop you from living your life, it's there to maintain some resemblance of order in society.
The more laws that are in place are not designed to create more restriction on your civil liberty as a citizen, they are to stop shit that isn't supposed to happen. Gun laws wouldn't have to exist if people didn't shoot each other. DUI laws wouldn't exist if people didn't drive drunk. There would be a border patrol if people/drugs/guns/etc. didn't enter the country illegally through our borders. They don't just make laws for shits and giggles... they exist for reasons. If you don't drive drunk, live here illegally, get involved in the drug trade, or have any desire to hurt other people physically you should be just fine.PNW Crew

The constitution prohibits unreasonable search and seizure, as well as self-incrimination. (Amendment IV and Miranda v. Arizona) respectively. checkpoints are constitutional, as Article IV, section 4 points out: "[...] and shall protect each of them from invasion". You might not agree with this, but the courts would uphold the existence of roadblocks as being necessary to secure our borders. Also, did you ever think that perhaps this road is known to be used by illegal traffickers? 40 miles is not really that far from the border. He is not questioned in a quest for evidence, nor is he accused of any wrongdoing. It's not any different than a police officer asking if you've been drinking when he pulls you over.
Also, he is not initially being detained. the agent is trying to determine if he is a United States citizen. When he refuses to comply, he is then outside the law and is detained until his citizenship can be established. Technically, he could be arrested for obstruction of Justice, so I think he got off easily. One of the Reserve instructor pilots here in Corpus is a Border Patrol helicopter pilot in Laredo, TX who takes fire while flying in support of the Border Patrol. What point is this guy trying to prove again?
And, before you complain about something being unconstitutional, read the constitution. If you're gonna argue something, at least know what you're arguing about.sigpic89 M3
