          Thanks guys. The problem is the driver isnt facing charges. Some people claim that he was actually driving the car and making a u turn.

            I guess I'm going to have to be the one to say it...

            I'm not AT ALL making light of the fact that those children were killed/injured. But wouldn't it possible for the vehicle to have "mysteriously" rolled backward down the hill even if he hadn't left it running? I get delivery from guys all the time that leave their vehicles running while they bring it to my door. I honestly don't see how he should be held accountable, unless he didn't have the parking brake engaged, which it seems must have been the case.

            Now if he was in fact driving, and hit those kids, that's a whole different story. But if he did have the brake engaged, and the vehicle was left running, but somehow managed to roll down the hill, this was clearly a freak accident.

              From the footage I saw, the street doesnt look like its on a slant. But the way I see it is if he did have the hand brake up and the car rolled, this HAS to be the drivers first notice. If he knew the car would roll even with the hand brake, that would be negligence since he did not address the problem.

                where was the adult supervision of the kids? thats the thing thats bothering me. i used to work for the boys and girls club and we didnt walk anywhere without the kids being in a straight line with supervisors in the front and back and middle if we had a 3rd person with us.

                  The news said there were chaperons and also this didnt happen while crossing the street. It was onto the curb and then into the kids.

                    Agreed. But from what I've gotten just from reading what's there, it doesn't sound like he was at fault. Yes, leaving the car running was careless, but not criminal. It happens dozens of times every day in every city. If he knew that there was some kind of problem that would result from leaving the vehicle and neglected to fix it, then I could understand criminal charges.
