    Statute of Limitations for speeding ticket question

    Just hoping somebody has experienced this before, I got a speeding ticket back on the 17th of June, I never received a courtesy notice from the courts with the fine and other info.

    The ticket stated August 21st was the day to appear at the courthouse, which I did go to. I waited in line and when I got to the clerk window he told me the ticket wasn't in the system.

    I asked what happened to it, he said the officer either forgot to enter the complaint or just hasn't done so yet. The clerk also noted that there is a statute of limitation of 1 year for the cop to file the complaint into the court.

    My question is, has anyone ever been in this situation and had the ticket never show up?

    Ive searched for it online but none of them are updated threads. They usually have people saying it will eventually show up.Also not showing up and ignoring the ticket wouldve resulted in a warrant for my arrest so that was not an option.

    I don't know the answer, but I do know that you should document EVERYTHING. Sorry I can't help more. BUMP for you.

      I was in the same situation as you Josh when I got pulled over by a cop about 8 years ago. The ticket that I got issued on wasn't on the system, I had several tickets after the "unfiled" ticket and when they ran my license, nothing outstanding has shown up. Just in case, keep that ticket, you'll never know. I would consult with a cop about the situation and they may be able to answer you. Good luck

        The noted the clerk attached just says call again in two weeks. So I'm going to try that and see what happens, Im really hoping it never shows up.

        Ive had a ticket appear in teh system then mysteriously disappear but never this.

        Im actaully gonna call and appear again so I can get another stamp if its not in the system in 2 weeks. I hope they dont make me check every 2 weeks because it not my fault the cop hasn't turned the ticket in or maybe lost it.

          you have to keep checking every few weeks, had the same situation had a bunch of stamps showing i showed up, took like 9 months for the officer to file it...what a douche!
          also had tickets and i paid them but they dont show up when i checked my record at the court so i dont know how that works...

            I feel like by coming back or calling every two weeks its just us doing them a favor to remind them. :\ Its crap that they arent held to a smaller timeframe to submit it because some people like me at least have to constantly think about saving money to pay for that ticket when I have other things to pay for.

            Its been almost 4 yrs since my last speeding ticket too, Ive been super careful abotu my speed and the day I drop my guard i get flashed. FML.

              I was written up for 11 fix it tickets at one time (Prerunner Nissan Titan) and a marijuana charge (before it was just a $100 infraction)...

              I got my card at 16, marijuana case was dropped and I asked the judge "Were there a few fix it tickets on there?" and they had NOTHING on file. Never came back to me

              Some lazy slackjawed government employee probably fucked up.

                I got caught speeding like 5 years ago on the Bay Bridge and was pulled over and got the ticket for speeding and no proof of insurance at the time. I returned to the courthouse with proof and paid the fine. Speeding ticket mysteriously disappeared from the records. I suspect clerk pocketed the $400 for the speeding ticket and just did a fix it for the proof of insurance and deleted the ticket. LOL ILL TAKE THAT!!

                  same here i had a speeding ticket from 4.5 years ago, checked at the court only one came up, no speeding ticket though they also checked my crimal record and nothing, the clerk told me sometimes they do that, the cases get lost and wont ever show up

                  gotta go check in LA since i have a ticket for running a stop and open container that my stupid friend had hidden on a bag but i checked and didnt appear maybe ill get lucky with that one too

                    Seems strange that you would have to keep checking in since the 6th amendment grants you the right to a speedy trial. Might want to look into the actual law or consult with a lawyer. Or there's some legal forums out there where a lawyer might be able to point you in a good direction.
