So I am sure a few of you have seen my threads looking for small case differentials in the past two weeks. Here the skinny: I bought a few small case differentials and one came and was broken and the member who sold it to me rectified the situation, so I bought another one and the member sent me a 410lsd MEDIUM CASE and I've yet to hear from this member after three pm's questioning why he sent me this diff against my specific instructions for a small case, in the meantime I bought another from another member and it was sent quickly via UPS and it turned out not be even be an lsd (the flanges spin opposite ways) or small case...he sent me a non locking differential in a medium case with a 4.10lsd tag bolted on and it was supposed to be a 3.91 small case lsd. So I called him and no answer then I sent a few pm's and i received a response telling me he sent me a small case 3.91lsd yada yada yada, so I can pretty much see where this is going....I've already started a dispute on paypal for the two but......ALL THIS HAPPENEND WITHIN THE PAST TWO WEEKS......and a few months ago I was gotten by some asses who said they're form atl and mt and the parts still haven't come!.....WTF is going on these forums?!?!?!
I've been reading that a lot of people have been getting screwed by members, this is just plain unacceptable.....I know the forums are not responsible for transactions but the forums should encourage good behaviour based on member feedback and punish bad behaviour based on the same. Is there a way we can ban people who screw other members, because this issue of deadbeat members are taking away from the experience of good members and taking advantage of the trust and community provided by US.
I will make threads for the two members who *^*&ed me but I wrote this because I wanted to make a general statement to the MODS and good members

Did you ask to see pictures of the diffs you purchased?

I will leave feedback, I am waiting for explanations that's why I didn't name names.

I specifically asked for the small case differentials and went through pains to explain the difference. The members I got them from were competent enough to explain to me that they were upgrading to medium case from small so that is why they were selling or in their explanation they obviously knew the difference.

And one diff came COMPLETELY different from what was discussed

So to cut a long story short, no I did not ask for pictures but i did not feel it was necessary for the diffs unless they took it apart.

I must be missing something. I know you mentioned wanting a small case but you got a BETTER diff than what you expected, what's the problem here?

It's not what I paid for, it not what was described to me prior to shipping. Also I was very precise as to what I was looking for in the thread I made and within the pm system. I sure a few members can atest to the thoroughness of my questioning. HONEST members after realizing they didn't have what I was looking for told me and the transaction didn't go through.
I didn't want a medium case differential I wanted a small case plain and simple. And on top of that I've had bad transactions three times in a row for the same goddamn item! Two of three members; I am still waiting for an explanation or refund from.

1 diff-broken
2 diff-not small as I asked for but at least 4.10lsd
3 diff-non-locking, medium, and the guy swears it's 3.91 but there is a S410 tag newly bolted on!

I guess that was my mistake all things considered....all the members involved have 318s so I assumed what they were telling me was the truth. They all seem to know the difference between the two

Buying and selling for a while. Been burned a couple of times as a buyer. Also had issues come up as a seller, lost in shipment, holding stuff for people with no show at the end, damaged during shipment etc.

All can be worked out. Here is what works for me get a phone number and talk live, especially if newer member or a large ticket item.

There are a few guys I don't even ask pictures I just take their word.

I can't remember the last time I looked up someones feedback. If I don't know them I want to talk live. Recently had two issues with buying stuff, called them on it and bam we worked it out. It's not the middle east problems we are trying to solve. If they don't play nice oh well won't buy or sell from them and will pass the word along.

At the end of the day I feel it just comes with the territory. Buying a $200 part for $30 has some risk. You can try to lessen it but risk never the less.

If you don't hear back post up their names not sure what that will do as I've also seen looser buyers as well that bitch about nothing(not saying this is the case here). Just saying if they are not a man to live up to their word in private public announcement will not help them either.

I've had a few problems with getting the differentials I want, but this guy is intentially screwing me over and apparently had been since we began the transaction.

I wanted a 3.91lsd small case differential.....I went through pains to explain which type of differential I needed and Joey confirmed he had what I looking for and he would send it out ASAP. Cool right? Everything is good until I get the package

It's a MEDIUM case differential that doesn't lock and there is a 4.10lsd tag bolted on. So either the clutch packs are fubared on the diff or it isn't a 4.10lsd......and most importantly it's not small case as I specifically asked for.

So I call him up immediately after receiving and no answer, so I left an voicemail and pm'd him. The next day I get a response saying all this crap about how he was positive it was a limited slip and it was in his car, THEN HE THROWS A BOMBSHELL...MEDIUM CASES ONLY CAME ON e36s and ALL OF THE DIFFS on the e30 are small. Even though this went against everything he said to me on pm's. By this time I had already begun a dispute we were conversing on through that system.

It was obviously he made a mistake and sent the wrong diff. So I offered to send it back after I get my refund and he tells me to sell it!!! I tell him I don't want to sell a differential I want MY money back. I requested a refund and he declined.....so I few more times I mentioned I want a full refund and I'll send the diff back and he didn't respond....so yesterday I requested a refund and he escalated the dispute and paypal said that:

"Our investigation into your claim is complete. As stated in our User
Agreement, the claims process only applies to the shipment of goods. It
does not apply to complaints about the attributes or quality of goods
received. Therefore, we are unable to reverse this transaction or issue a
refund."

I saw this this morning and I was livid, paypal doesn't open for a few more hours and I want to appeal this crap...

Also I've spoken with my local police department twice. Once about three days ago and once yesterday after they told me orginally to try one more time to work it out before proceeding. Well, I tried to be patient and understanding, I even offered to send the diff back to him in exchange for my money. To no avail!

The police have all of your information Joey Dewaard, they will be forwarding all of the evidence to your local police department for processing. I suggest you take me seriously on this matter because this is now angering me as this is more than just an inconvenience for me.

The process has already been started, and can only be halted by me receiving a full refund.

Does anybody know this person? He live in Seattle or around that area

Unfortunately that is true. Paypal will not reimburse you for anything purchased outside of ebay unless you never recieved an item. In theory the guy could have sold you a diff and shipped you a stapler. Once you said you recieved a package, you lost that claim.

I don't think there's a lot you can do here. Yes I know you are upset and it is a messed up situation, but you recieved a differential. It isn't what you thought you were recieving but you will have to argue that in court. You can't file a case in his locality unless you are there..... stupid Constitutional rights say something about the accused have the right to face their accuser..... So either you resell the diff or you suck it up. I'm sure you'll press the issue with your local PD which is the right answer, but dont' be suprised if they don't drop this same answer on you at some point.

well I have a west coast trip coming up very soon so I may just make the effort out of principle. I am very angry right now and this is unacceptable. I am going to follow through with the police on both sides as far as I can. I may have a case of internet fraud being the transaction was conducted over the internet under "US Code: Title15-Chapter 2A-Sub-Chapter I-77q Fraudulent interstate transactions"

When I showed the detective the messages and pictures of the difference, he told me that what I was doing would have serious consequences if everything is proven right and that I should exhaust every option to settle this amicably. I did everything I could do. If someone lives near him or knows him, tell him to call me with a resolution...that about all I can do until I am able to get to the west coast myself.
