So im going to be rebuilding my cars transfer case and i know that part from BMW is NLA. Is there any way to source a new one or is it just a shit out of luck moment.

it's not NLA (yet)... you can get one from BMW. but practically it is, because it costs about $1000.
it's NLA in that they aren't being manufactured any longer by Borg Warner. There are options (using two snowmobile chains) but they would require some R&D and machine work.
