    Failed SMOG CA

    Just got back from the smog test and failed the 15mph test
    heres the print out...


    Just bought the car and need it to pass smog so I can register it.
    any help is very aprechiated

    forgot to metion something I thought was wierd dont know if it has anything to do with it but my temp guage seemed to be stucked at about 1/3 and wouldnt go any futher while driving around to the smog place...like I said I dont know if this has anything to do with it but maybe one of you guys might know

    When was the last time the car had a tuneup? Cap, rotor, plugs, valve adjustment?
    How old is the cat?
    Any vacuum leaks?

      well I just bought it so im not sure about everything but I know it had troubles last time the owner said (2 years ago) he had to replace the cat and a bunch of the hoses not sure when he last had a major tuneup

        Seller is responsible. Call him, tell him he needs to make it pass or refund your $$$$$

          thats the big problem I pretty much screwed myself on this one I signed a bill of sale which he stated he isnt liable for smog/registration

          ...so im pretty much stuck and have to fix the problem...

            I do not think it is binding. The state of California says he is responsible. How old are you? If you are not 18 you have no right to sign a legally binding document.

              Just turned 18 yesterday :(
              but my mom signed the pink and the bill of sale...since we bought it about a week ago when I wasnt 18

              I found this from the link you gave me

              "Section 24007 (b)(2) of the Vehicle Code states it is the responsibility of the seller to provide a valid smog certificate at the time of delivery of the vehicle. There is no provision in the law to sell a vehicle "as is.""

              But would the bill of sale that was sign go over this?

                Change you title and put R3v lawyers on it! Did the buyer say it would pass smog? I gotta tell you (which you now know) if the buyer says they cannot be held responsible for smog then the car may be screwed. How old is the cat?

                  the cat is 2 years old it was replaced last time it was smoged

                  the thing that pisses me off is this guy lives 2-3 blocks from me And the reason he was selling it was because he has 2 kids and bought 2 safer cars (SUV and a volvo) and didnt need this one and let the registration go..which is why I thought he didnt want to smog it.

                  im getting the title transfered but what sucks is that Im pretty sure it has to pass smog first...

                  he didnt say it would or would not pass smog all he said was that it had to be fixed last time which it was than it passed smog

                    Get an estimate to smog it, then take it to him, print out what you found on the DMV site, along with the link to it, go tell him the state does not permit as is as far as smog goes, ask him to pay, if he refuses we can go from there. Maybe it needs a vacuum hose and will cost .20 cents to fix.

                    You need to not transfer title (they will transfer, but not register until you provide proof of smog and insurance) until after you know what you are looking at to smog it. If it is expensive he needs to pay or take the car back.

                      My, my...

                      California must be a parallel universe. There are fewer and fewer "hot rods" on the road. It is no stretch to see why the street crowd is dominated by Honda Civics and other ricer rollerskates. Any thing else is a trailer queen because you can't drive it on the street.
                      We just got annual smog checks here in Austin. Our checks are part of the annual safety inspection and have nothing to do with title, registration, or license. If it's a late model with the diagnostic plug, they check it by plugging a scanner into it. Older cars are the only ones that get the tailpipe check. Also, there are no buyer-seller requirements. You buy it and it's yours.
                      I always try to make the Long Beach Gran Prix and I'm always impressed with the yellow air so I guess it is necessary. Still a shame though.

                          well thanks for all that have help and replied.

                          Im taking the car to get it inspect. today and they want me leave it over night so I guess Ill find out how much the estimate is tomrrow. Ill keep you guys updated and once again thanks a lot

                            Hey Panda, glad you could make it to R3v.
                            why didn't you tell me it was your b-day yesterday? ;)

                            It could be o2 sensor,but I can say for sure.
                            After you get the car inspected,call me up and I'll see if I can help you out.

                              What are you talking about???? There are "hot rods" everywhere up here. I know you are worried but let me assure you the car culture is very much alive and well in nor cal. Most "rods" are ca exempt due to age. Unless you consider late 80s mustangs American Muscle. Plus it is a must in major cities.... ever been to atlanta in the 80s? If you have go now and you will get a good feeling on the difference in air quality.
