Speeding Ticket-Trial By Written Declaration-Help?

    the only way, and i mean the ONLY way you can win is if you can prove that the road has not been surveyed for speed in the last 10yrs and that you were going the speed of traffic, in which case the posted speed limit needs to be RE-SURVEYED and re-posted at a new speed.

    otherwise you are waisting your time.
    trust, my brother just got a ticket in topanga canyon for doing 58 in a 55 and the cop wrote it for 65....he still broke the law, end of story. yes its bullshit!

      Obviously you havent read any of my previous posts. Youre wrong on all counts here. It is not the responsibility of the people of California to pay frivelous tickets to bail out the economy from a debt which the lawmakers have created. Thats what taxes are for. Read my posts. No where in the CVC does it say that it is Illegal to go above the posted limit (unless its on a highway where even then there are extenuating circumstances as to being able to shortly be travelling above the posted limit). It DOES say that it is too fast for the conditions.

      On the street is is completely legal to go above the posted limit (within reason of course) if "the conditions permit". So you go about proving that there was absolutely nothing about the conditions that made your speed unsafe. It is a "suggested" speed that is arrived at by reducing the speed survey's average speed by 10% and then rounding down to the nearest 5. I have beaten more than my fair share (at least 6, Ive lost count over the years) of speeding tickets for myself AND my family and friends, so your "wasting your time" decree is also erroneous. These were decided by a judge who knows about the laws more than anyone. And the "only way to beat a speeding ticket" comment is also wrong because the cop can choose not to respond to the call for his version of events to the judge in which case, even if all you put down is "I am not guilty", you win.

      Another way is to allege that you were speeding up to avoid a dangerous situation on the road by passing another car and picking up speeding up temporarily. Yet another way is to prove that your speed was NOT dangerous due to the conditions at hand by using the cops own admission (on the ticket) by proving the weather was clear, it was light outside and visibility was good (thereby squashing the charge) because the speeding code they use states that"you are going to fast for the conditions. So, by simple reason of mathematics, there are more than one (the only) way to beat a ticket.

      "Grantlacey" literally JUST recounted another "way" to beat a ticket, so there cant be an ONLY way, if there are more than ONE. So you literally are wrong on all counts. Before giving "suggestions" based on one experiece that your brother had. Learn a bit about the CVC and try beating multiple tickets by declaration and succeeding before giving your assumed-iron-clad "knowledge". This is exactly the kind of ignorance that keeps people paying tickets unnecessarily and keeps the municipalities and cities dependent on traffic tickets for funding unethically-written tickets.

                It just irritates me to have misinformation spread around like its gospel with an extra sensation of condescending douchebaggery, and little effort in actually helping, especially when I know better. Its the kind of "suggestion" that benefits no one especially when it is wrong. I didnt take it as an attack. You werent even speaking to me so it couldnt possibly be an attack on me. I took it as being severely incorrect. And its not an opinion when you say definites and absolutes like "The only way and I mean THE ONLY way", its the same as saying "always" or "never". Thats black and white. Those imply that what you are saying is fact, not opinion. Which, in fact, they are not. On top of that, no where does it say that that was your opinion. It was a definite imperative declaratory sentence. It wasnt, "in my experience" or "in my opinion it is a waste of time". Just "Otherwise, you are just wasting your time". Point blank. "Because 1 of my family members tried it, it must not work." ;) On top of that, you add an extra degree of douchery when you snipped "Have fun funding California's debt."                   i just got my first speeding ticket ever in 10 years of driving..clocked me doing "50" in a 35 ..i know i was not doing close to 50 but was polite etc he wrote it for 44 in a 35 ..will cost me 128 bucks and online traffic school to get rid of the points...i am not even gonna fight it considering some of the shit i have done and not gotten tickets for ..
