if you get busted for breaking the law, just deal with it.

    ffs.

now if he said you were doing 90 and you were doing 70, then definitely do something about that. those are 2 very different tickets.

Regardless of the "flow of traffic" you were the one picked out and pulled over. What is there to argue?

driving the speed limit, aka under the flow of traffic is more unsafe in LA.

I somehow fail to see how that works. Get on the highway, do the speedlimit, stay in the inside lane and laugh at those that can't deal with it.

I dont disagree with you but it is still speeding and that argument would never hold up in court.

Speed limits are there for more reason than to make money. If you dont like it, too bad, but dont bitch about being pulled over for speeding if you were driving over the limit.

officer pulls me over saying i was doing about 85-90 i asked him for the radar gun he said he was pacing when he was no where near my car. CALIFORNIA HIGHWAY PATROL OFFICERS will pull you for no reason... i was doing 120 in a friends sl55 and the chp officer told me to slow down because he was a 11-99 chp member lol

You can request the calibration reports for his cars speedometer. However he didn't get a actual pace on you so it should be pretty easy to fight.

Not when its totally legal to go above the posted limits for many reasons that I will not get into here. Ive gotten off of 5-6 tickets myself and for my brother.

The usual violation is "Basic speed law" which states that the speed is unsafe for the prevailing conditions.... but the officer must state why it is unsafe "traffic flow/light/weather conditions" and they usually dont fill those out, which helps your case in proving he did not say WHY your speed was unsafe for conditions. If they do fill those out, and they are all benefitial to your case, then the cop has just helped your case. It also states right there in the vehicle code that there are a few situations in which you are allowed to go above the posted speed. For instance to pass a dangerous or much slower motorist or when you going the posted speed limit would only make you an obstacle and an easy target to get rear-ended. It says that right in the CVC. People who are saying "sack up and take it up the ass" are falling exactly into the hands of these opportunist and money-hungry cops who expect the citizens to have no hope in fighting tickets and just pay the fine and take the point on their record.

Also, trial by declaration is better to fight your ticket for a number of reasons #1 The judge will rarely if ever rule against the porcine in open court #2 the swine must send in his version of events without ever seeing your face to remember exactly what happened (and if they dont, you win no matter if your letter just said "Im not guilty") #3 they are less motivated to send their version in, since they arent getting paid overtime to do so like they do when showing up to court. They have to do it on their own time #4 Even when ruled "guilty" one can ask for a bail reduction and/or request to be given traffic school even if its a 2nd time in 18 months (its been granted to be) #5 One can re-try the case in the face of a conviction (the only place in the US legal system where this is allowed) and then you do go in front of a judge with all your ducks in a row. Theres a reason that they dont tell people about trial by written declaration and little is known about it, they want to avoid the fact that its more convenient for you, and that you just want to go into court, plead, and pay and get it over with. This is all very well calculated, people. If it werent done and tickets given willy nilly and the whole process done in such bad faith and in such a blatantly revenue-seeking manner on the part of the bacon and the "justice system", I wouldnt be so bitter. But I have had many and varied experiences and this is my opinion from 15 years experience in fighting tickets, winning, and learning how traffic cops operate. They abuse the system unless you stop them and are informed. Just like they take advantage of search and seizures of your car, and your home, if you let them and are unaware of your rights. They are people too. Some of them barely, and people will look for advantages and use them when they can, in general.

Its totally possible to fight it by mail. Thats the whole point of trial by written declaration. I can send you the form that is required to fill out. I have it in a PDF file. Only thing is you have to somehow call and tell them you will be fighting it by mail, just to cover your ass.

Oh and FYI my brother JUST got another "not guilty" verdict last week so you can mark another one in the win column. It works, people. I laugh at the people who just say "deal with it" and condone the system giving to you squarely in the ass with no oppourtunity to present evidence, prove ones innocence. I suspect these are the same people who are happy to live in a country where challenging charges and exercising ones rights used to be encouraged.

Spot on...i've beaten 2 tickets by TBD and my sister just got her bail back from winning hers a week ago.

Just an FYI, cops take notes. If you get pulled over, please make yourselves as bland as possible...don't give the cop a reason to take notes on you and your car. Once you get the ticket information in the mail, I would wait until close to the deadline to go to the court/clerk or call in and get an extension. Fill out the TBD form and turn that sucker in just before the extension is about to run out and don't forget the bail (only 1 extension granted in L.A.).

Good luck...your refund, on the bail, should arrive in about 3-6 months :)

Exactly everything this man said is true. But I think the guy is trying to avoid the 7 hour trip to the court corresponding to where he caught the violation at.

Yeah how do you like that. Theyre quick to take it from you and you cant be late, but they take their fucking time giving it back to you. Just like anything.
