    Anyone have criminal court experience?

    As some of you may remember, I got a reckless driving ticket a few months ago near the San Jose Airport for taking a turn too fast (35 in a 25 by my speedometer, but obviously the cop had a different story). In case you don't remember, here's the quick summary:

    I took a turn just outside the airport a little fast in the BMW (about 35 in a 25), but I downshifted just before the turn so the exhaust got pretty loud. A half mile later, I see an SJPD cruiser with his lights and sirens blaring so I pull over. Cop asks me why he pulled me over, I say I dunno, then he goes back to his car. 45 minutes later, he comes back out and says that he saw me spin my tires, peel out, almost hit a few pedestrians, and almost hit a few cars. Then he hands me a ticket for reckless driving, a 2 point misdemeanor (meaning it's a criminal offense). Absolutely none of that happened, and in fact, the exact opposite of what he said was true: I did NOT spin any tires, there were no pedestrians because it was a construction zone and there were no sidewalks, and there was zero traffic on the road. He hands me the ticket and tells me to sign it.

    So I had to hire an attorney because I don't want to represent myself in a criminal court (traffic court is a different story). The cheapest attorney that seemed reputable was $2,000, so I blew a damn good chunk of my savings right there. Three months later (meaning right now), there was a pre-trial hearing in the county court, which is when my attorney and the DA talk and try to cut a deal. My attorney says that I'm a good student with a clean driving record and that I admit to speeding, but not reckless driving. Then the DA replies by saying, "Yeah, I know he has a clean record, but I want to go after him anyway." Son of a bitch! That is so typical of this county; they want to make an example of every case and lock people away for life. So now we're going to trial and my date is set of 1/26/04. If I'm found guilty, then it's up to the judge to sentence me, and knowing them, I'm probably going to get the maximum penalty of 90 days in jail/$1,000 fine because I fit the description of a stereotypical Asian street racer, who as well all know are guilty for over 10 million deaths per year and deserved to be locked away for life.

    I can't tell you how frustrating it is to live in this county. It's fucking bullshit that I have to waste over 2 grand on something that I didn't even do; yes, I'm guilty of speeding, but at worst that is a $300 fine and 1 point on my record. Now if I'm convicted I may have to spend time in jail, then deal with my insurance tripling or quadrupling for the next 6 years. I have little faith in the judicial system here after what happened last time in court with my old employer. According to my attorney my chances of getting off the hook are best with a relatively young all-Asian jury, but that's probably not going to happen. I don't have very high hopes for this trial at all.

    Anyway, the only 2 people going to take the witness stand is me and the cop. Does anyone have any tips on things to say/not to say, etc? Thanks.

    Fred.. I really feel for you here. There isn't much you can do but hope for the best, but I like you have very little faith in the judical system.

    Make sure you and your lawyer do their best to discredit everything the pig has to say. It would have been smart to go back to the scene and take many photos, but its likely too late for that now.

    If all else fails, pull a gun in the court room as see how many people you can rub out before you take one to the head.

      Thanks Jordan. I actually went back to the site a few days later and took about 20 digital pictures before the construction was finished and gave those pics to my lawyer. That should help me explain things to the jury.

      Haha, yeah, if I'm going to go to jail I might as well do it in Grand Theft Auto style :twisted:.

        Hate to be the bearer of bad news Fred, but dig pics have a tendancy to not hold up so well in court, as they can be altered. That's how it goes in NC, hopefully CA is different for your sake. Either way man best of luck to you, that truely is a bogus charge. If you do get off for this, go after the pig's badge. :twisted:

          that's fkued up, I know how frustrated you are at the whole thing.
          To go to jail for shit like this is ridiculous, I see bastards dealing drugs on street corners and nobody gives a damn about them...

            PS: take down as much info about the cop as you can, and get him back in ways he will really regret (personal attacks on his house/cars, while you are in jail, just so he can't say it was you )

                  So sorry to hear this Fred. Unfortunately, you have to win this case as professionally as you can. You need to use technicalities to win this case. The basis of his claims need to be queried with exceptional scrutiny. I am not trying to be mean about this but if your attorney seems to be slacking, you might want to make sure you tell him you're not feeling too confident with his demeanor and wish for him to act more serious. This can go on your record or....?

                  Tackle this guy with technicalities, its his word against yours. Supposedly his world in golden court infront of the judge.

                  This is pathetic of the cop to frame you...this is straight stupidity and seems to be a biased charge because you're young with a "flashy" looking car.Best of luck to you. Keep your head up !!

                    Sorry to hear of the bull shit they're pulling. I've dealt with police too often in my glorious youth, most of it bad. I've definitely run into the exaggerated reports filed by cops. I'm not a minority though, which could change things for you. Here are my suggestions.

                    You might want to print your digital photos onto good photographic paper and use the prints instead - they'll hold more weight in court. Was there anyone in the car with you? If so, having them attend to argue your case is not necessarily a bad thing as long as they are clean cut, have no records, and can present responsibly.

                    To be honest, I'd be honest. Tell the court your car is modified, you downshifted and this may have caused a chirp that you didn't hear, as wel as a high rev which could be interpreted as a spin out, when in fact, you were actually trying to slow down for the upcoming turn. The fact that you took a turn at 35 instead of 25 in this case is relatively minor in the scheme of what is being presented.

                    Make sure that the report that was filed with the courts identifies that you almost hit pedestrians and other cars. If it doesn't, he was probably just exagerating the incident and it may be something that never comes up.

                    I've been to too many court appearances and hope to never go back. Over the years, I learned the following about court appearances:

                    Always dress well
                    Speak proper English, no yeahs, etc
                    Always address the judge as "Your Honor"
                    Argue your case, emphasizing that you've made a mistake - but only the ones you feel you honestly made, ignore anything else - if you deny it, it may come back, if you admit it, it may also get you. Omission is a better option.

                    In your case, you might want to ask your lawyer to question the officer about the pedestrians you almost hit - assuming that he listed this in the report. I think it would be a bit strange for him not to be able to give any details about them. Of course if he's a lier, it won't matter and he'll make it up. At the same time, your lawyer should be looking into this cops records for patterns.

                    Lastly, I can't imagine that a judge in sound mind will inprison someone for reckless driving. It would be a bit obsurd. The likely, and most extreme case may be a suspended sentence which would place you in a position of not being able to get a ticket for a year or two, however long the sentence is suspended. A fine may result, as well as some community service. I'm still a bit taken aback at the thought that this is a jailable offense.

                      Thanks for the replies. I actually printed out all the pics on high quality Kodak photo paper (so it looks like a regular 35mm camera was used) and gave em to my lawyer a couple months ago. Hopefully they won't question the validity of the pics. According to my attorney, the 90 days jail time for reckless is supposed to be if there was damage as a result of my driving (ran into someone's house, plowed into a car, damaged city property, etc), but the DAs here have such a big stick up their ass and are so out of touch with reality that they are probably going to push for a jail sentence.

                      I don't see the problem as being California, but just Santa Clara County. It's actually politics; this area has a record of being a supposed safe and clean community, and the government (elected city/county officials, judges, DAs, and police) takes a hardball approach to everything. Very few people get off the hook for anything; which is good for repeat felonious criminals but bad for petty one-timers, which in turn ties up the legal system and costs millions of dollars per year.

                      If I don't get off, I'm hoping community service or just a monetary fine would be the outcome. I agree, I will admit to speeding but you gave some sound advice to ignore everything else. Of course, I'll have a conference with my lawyer a few weeks before the trial to see what the game plan is.

                      No matter what the outcome will be, I'm not going to go after the cop personally. What goes around comes around. Anyway, we'll see what happens in a month. Thanks again.

                        You are innocent until proven guilty. YOu are probably fuked at the hearing but plead not guilty and take it to trial. Its the cops job to prove you guilty so unless there are credible witnesses of this behavior or video evidence of it.

                          I keep getting the cops called on me by my negihbor for playing my drums. Apparently its illegal to play drums inside your house, with silencing pads that mute sound 75% during the afternoon. Yeah still gotta go to court for that ticket. :roll:
