edit: if you can prove that by driving over 5mph you were not endangering anyone or their property and were driving safely for the road conditions I am sure the judge will drop the case. 5mph is laughable. i also suggest you do this by written declaration. if you go to court the cop gets paid for showing up. if you do it by written declaration the cop gets paid nothing for doing his paperwork and proving his case, thus cutting back on the chance that he will try at all. read all the speed laws for washington and write yourself a nice fat argument. i dont know what the laws in wa say but here in cali you have the right to do traffic school and get your fine reduced even after the judge decided against you the first time.

OP that sucks, i feel for you. If it were me id show up to court (with or without a lawyer, your call) and say your sorry, might help but never been in the situation.

And 2% discrepancy dosen't work. The tires on my truck are 6 inches taller than stock and i changed the diffs from 4.10 to 5.29. It is up to you (not anyone else) to know how fast you are going. leniency yes, discrepancy no.

Anyone here have stock sized tires? I don't, never have since i bought either of my vehicles. My bikes don't even run stock rubber. Its still no excuse.

To add, i've been in Ashland for 2 weeks now, the main drag is maybe 6 miles long. 25 miles an hour the whole way. and for a section it is 20 mph. Also this street is Hwy 99 (same as in portland). Ridiculous yes, i drive the speed limit until i get to the highway though.

I was moving with the flow of traffic, I wasn't overtaking other vehicles.. this was one of those days for me, but for those who feel otherwise, jus disregard it.

A lawyer might help here. No source but I believe the flow of traffic helps your situation. If you were cruising slower than everyone else you woud be a danger on the road, weather it be 50 in a 55 or 60 in a 60 with everyone traveling 65.

Second thought on this is entering on an onramp. To my knowledge (more than the previous statement) it is legal to "speed" when merging from an onramp.

If you drove 65 mph for 1 hour exactly and someone else was following you driving 60, you would only be 5 miles ahead of them @60mph = roughy 5 min. the average commute to work or school is <20 miles, which means the time savings is around 1.5 min.

moral of the story...drive the speed limit, save yourself some money and enjoy the extra minute with your beautiful, loving E30.

All I know is CHP is worse than any other highway authority out there. And the fines in California are just outrageous. $93 for 5 over is like a miracle, if you got pulled over for 5 over in Cali it would probably have been almost $150 just because this state is so deep in the hole.

Maybe this is why everyone with WA plates drives like a DB in OR. They hog the left lane at under 60 like it is their job.

Anyway, OP, that is a dumb ticket, even if some people are trying to hate on you here. I've never been pulled over for less than 10 mph over the limit, in any state in the country. I'd temper that with the fact that you WILL get hammered for any speeding whatsoever in small towns the need money, but that is just revenue building and goes with the territory. It is surprising that anyone patrolling I-5 would hit you for that. Yeah the law is the law, and you were breaking it, but it is still dumb.

I remember reading that you can drive 2mph over 65mph speed limit, but I can't remember/find the article anymore.

I think there's a bit of grace period above the speed limit (just not 5mph) because there are some drivers who aren't as skilled as to be able to drive on the dot of 65mph

speedometers on factory cars are usually adjusted higher than actual speed not lower than actual speed. therefore your 2% theory is out the door. meaning the kids speedo was showing 70, we was clocked at 67 (your speedometer discrepancy) and the dick cop that wanted you to feel like he was doing you a favor for writing 65.

i have had a handful of cops write the exact number that the radar or laser showed and didnt adjust for shit. even had one give me a ticket based on pacing over a mile behind me, and trust me we got into an argument on how A. his car is exact or not B. how you can gauge if you are following someone a mile behind and they are going the exact same or faster speed.

The tolerance for speedo discrepancy is 0>+10%. Meaning the speedo can never read more than it indicates, but be at least wihin 10% below what it indicates. Specifically for tire size disrepancies. Now this is a manufacturer tolerance, and has been for ages. But, you are not the manufacturer, are you?

The 2% leeway is of the posted speed limit, for speedo discrepancies. Or 1mph for anything under 100mph (All posted limits). Why on earth would I claim 2% for the speedo when your tire wear breaks that percentage?

And, in my state, 2mph is $40 dollars or so less on your ticket. So yes, if found guilty it would be a $40 or so dollar favor the cop gave me.

I speed. All the time in fact. But will I complain about a 5mph over ticket? Nope. Cop caught me fair and square. It's my fault for not being vigilant when breaking the law. It's now up to me to take matter into MY hands, cross reference the officer when court comes, and most likely have the ticket thrown out unless the officer is on the ball that day.

Moral of the story. I dont really give a fuck either way.

I live in MA but know if driving through some small VT towns (often with minimal signs posted) I have to go extra slow. You will get ticketed if you have out of state plates and are going 5 mph over the low speed limit the town has. They know that it is much harder to appeal if you have to come back to the state and its not true it will be dismisssed simply because the cop who wrote the ticket is not there. Another officer will stand in on hearing day. These are civil not criminal motor vehicle infractions. These type of tickets are mainly issued to generate revenue I'm sure.

The real killer is that a minor speeding ticket will give you a 6 year insurance surcharge in my state.
