    next bit of info

    I checked with ebay. They said that Ihr Anwalt 24 contacted them and by their authority the auction was cancelled. Todays registered letter is by Ihr Anwalt 24. Along with the letter is a power of attorney from Hartga giving Ihr Anwalt 24 full power in the matter.

    Here is the notice from ebay.

    wir wissen es zu schaetzen, dass Sie sich dazu entschieden haben, Ihre Angebote bei eBay durchzufuehren.

    Zu unserem Bedauern muessen wir Ihnen jedoch mitteilen, dass Ihr folgendes Angebot auf Anforderung der Herbert Hartge GmbH & Co. KG, einer Teilnehmerin des eBay VeRI-Programms (Verifizierter Rechteinhaber Programm), vorzeitig beendet wurde:

    I realize that only a few read German, but it basically says that they know I didn't mean to tarnish the reputation of Hartga, but it is not allowed and the auction was removed.

    Theres about 50 auctions on german ebay with the Hartga name active right now. Most are doing exactly what I did....listing a BMW original part and using the hartga name as a key word. We will see if those get dropped as well.


    I know this seems like a scam, but when your name and your cash is on the line it seems pretty real. It must of been pretty real to ebay if they cancelled the auction..... :?:

    And I wish I spelled the name incorrectly on the auction...but I didn't :roll:

      Call a lawyer that will work pro bono (without pay until lawsuit is setteld). If you just pay the $1000 your a moron. It might cost you a few hundred in legal fee but you'll save some money.

      Even though you've recieved multiple letters doesn't mean its not a scam. Ebay will cancel an auction at the drop of a hat.

      Contact Hartge directly, not using a phone # you recieved in the letters. Check with them before consulting an attorney.

        If I were you, I would contact ebay and mention the other auctions using the name and find out why they were not cancelled and contacted like you were. Maybe even include links to past and present auctions similar to yours. Might be entertaining if not educational. :twisted:

          Tell them the check is in the mail but you over payed so they need to send you the balence back in cash. Oh and then go F**K off, this is bullshit, do not send any money .. period..

            OK. While probably a scam, let's ask a few questions...

            Do both letters you received bear the same watermark? Law firms often use watermarked paper for letters for authentication purposes. Hold the letter to a light-are there markings, or names and are they identical between letters?

            First, though, I think I would....

            CALL HARTGE! Ask to speak with whomever deals with trademark infringement cases and find out whether they're really after you. Be cordial, calm and professional sounding. Avoid sounding helpless. At the very least, they'll be able to tell you whether the law firm claiming to represent them was actually hired by them.

            If not, then turn over everything you've received thusfar to the police. They might want to speak to these so-called "lawyers".

              Call the number on the letter and tell them to fuck off directly! Tell them to serve you process or whatever they do in Germany, tell them to spend thousands trying to sue you, Claim an american address, first off and make them try and serve you here, hahaha.

              Failure to pursue similiar cases is a waiver of thier rights to protect thier rights against infrignement.

                This has gotta be a hoax, for all the reasons listed above. If all those other auctions are doing it, have been doing it, and will ALWAYS be doing it, why are you the bad guy they decide to pick on?

                  lol send em a bag of flaming shit..... dont pay a penny.... hoaxing from accross the seas are everywhere. I got one saying i won 600k from some national lottery my parents entered in 10 yrs ago. Of course they asked for 3k in "processing fees" first. Like I said send a flaming bag of poo.

                    Hartga update (long)

                    Well, its not a scam. The lawyer that sent the papers is representing hartga. I spoke with hartga directly, they said the lawyer has been given a power of attorney from them to pursue any unauthorized use of their trademark.

                    I am currently watching every Hartga auction (20+ at the moment) None of them have been removed and if I'm ever actually brought to court maybe they can be used in some way.

                    Hartga said that they sent out over 40 notices to people in reguards to their trademark rights. He said that he has received several calls from irrate people telling them to fuck off. (go figure) I tried to explain that I am not making Hartga knock offs and selling them as the real thing....that I only used their name to receive more hits on ebay. As we were speaking he was looking at my feedback. None of my other auctions had their name on them, and I told him that they have zero proof that I ever made one cent using their name. (TRUE) He sounded surprised when I told him the amount the the lawyer wanted (3000+euros).

                    Thanks for some of the good advice given on the board......

                    After reveiwing the lawyer's paper, its clear that it is a copy, that it has a date penciled over, and that where it should say spoiler it auctually says mirrors. (they must of used the same paper and just changed the names, auctions, and items) and they forgot to change my item.

                    Since Hartga didn't seem to know exactly what their lawers were doing, we are forwarding a copy of the lawyers paper to them pointing out their very poor work. (work that they are trying to charge me for) I dont know what it will accomplish, hopefully stir up some shit!

                    I hope that after they reveiw that facts in our case they will just let it go. Like I told the hartga guy....a simple warning would of done it. If I ignored the warning, then I should have to pull out my wallet and bend over.

                        unless some fake company called Hartga is suing you.

                                Jesus, that's two people that took the time to post telling him he's spelling it wrong, but couldn't take the time to read the fucking post and see there's a reason.

                                He lives in Germany you pricks - I'm sure he's better at spelling Hartge better than most of us. :)

                                Keep us posted. Penciled in date, overwritten items, sounds fake to me.
