    help. i need to beat this ticket in court?

    ok so i got a ticket for following to close. i was approaching an accident that was in the grass and in the break down lane. i was in the fast lane on the highway with two cars in front of me. we were going about 30mph. the car in front of me slammed on it breaks and came to a complete stop (probably because the guy in front of him did also). i also hit my breaks and came to a complete stop. my tires made some noise. no one got into an accident. then we all just went about our way. about two miles down the road i got pulled over and got a ticket for following to close. the officer said i almost caused a pile up. i think that if i was traveling to close i would have hit the guy in front of me. i was put in the most severe situation and did not hit the person in front so i'm pretty sure i was not to close. what are your thoughts? the definition of following to close is if the person in front of you stops you would not have enough time to stop without hitting them?

          It's like getting a ticket for running a red light. Even if you were through before it went yellow -> red, it's word vs word.

          It's the last week of the month....the gotta get their quota....

            he never saw me tailgating. He was to busy looking at the accident. He just heard the tires then turned around. He also told me that they were yelling at me to stop and I just drove away. I said " if I heard you tell me to stop I would have".

              Take it to court, If the cop actually shows up ask him how close you were to the car in front of you and how fast you were going. When he can't answer the case will be dismissed.

              Some places you can write in so you don't even have to go to court.

                Good luck with this. Seems like you are in a shitty situation and I agree with the stuff above about his words vs yours. How much is the ticket anyway?

                  General rule is one car lenght for every 10mph.... Go to court ask the officer what all his responsibilities were on the accident scene. After he rattles off about 3 or 4 things kindly explain to the court how his attention was clearly focused on other tasks that he could not have possibly been able to focus soley on you, your distance, and speed. Also prob worth calling the PA and explaning the ticket to them,,, they would prob drop charges as it is a hard ticket to prosecute without any witness, if he has another officer that was their though your screwed.

                    the ticket was only $35 and it cost me $25 to fight it...... i would just pay it but i am in a shitty position with tickets already. ive lost my license multiple times. i havent gotten a ticket in over a year but i got at least ten in one year. i got 3 tickets for my inspection sticker in one week a couple years ago. i drive like a grandma now. anyways if they dont drop it am i able to go forward with it and take it to the next level. i'm not sure if i'd lose my license with this ticket but its not worth taking that chance.

                        since the cop didn't see anything i know what i'm going to say. i will tell them that the guy unexpectedly got into the fast lane in front of me and slammed on his brakes. i dont think they can argue with that and it can very easily happen.

                          Seriously? It's a $35 ticket. I just got three tickets, one for defective equipment, and two for registration being expired/non-existent (two different cars).

                          Equip ticket was $36

                          Registration was $92....each.

                          Find out if it will put points on your record. If not, fucking pay it and move on. If so, you can justify fighting it. My ex got one for speeding in a school zone, turned out to be a "failure to obey traffic sign" and it was a non-moving violation = no points. Pay it and go. Usually the small fine amounts don't = points.

                            The advice all these people are giving you about trying to trip up the cop in court is totally idiotic. You're not Perry Mason. You have zero experience in a courtroom and the cop is there every week. Not only is he far more experienced than you, but he's one of the boys; he's probably having coffee and blueberry pie with the prosecutor as we speak. It's retarded to treat the cop as your enemy and try to take him head-on in court.

                            If you're smart, you try to get the cop on your side. You should take the approach that the cop is a good guy doing his job. I'm sure he saw something he didn't like, and that's why he dinged you for it. Explain to the prosecutor and/or judge that you were just trying to avoid an accident. Maybe what you did wasn't perfect (and you understand that's why the cop nailed you), but you did the best you could, so please don't penalize you for trying to do the right thing. 9 times out of 10, they'll give you a break.

                            If you don't think you can handle that, then (a) don't bother trying to fight it; or (b) hire a traffic lawyer to represent you.

                              its a moving violation. doesn't matter how much it costs. i'm not going to be a dick about it. the cop isn't there anyways. its just one cop that reads all of them. i will explain that i did not have any other choice then to slam on my brakes. its obvious that i was too close. a car length for every ten mph..... who does that. if we were doing 30 i was not three car lengths from him. so yes i was following too close but he never saw what happened and what led up to the the events. he just heard tires and turned around. i can say whatever i want happened. if i say the guy went into my lane unexpectedly and hit his breaks before i had time to back off of him i think i'll be fine.
