    Need suggestion on what to do?? sell gone bad...

    Hi people,

    I was selling a vert on here a while back after to much back and forth with some. I decided to take it off and keep it. A few weeks maybe go around and I get a pm from a member asking if I still am selling the vert. I say not really but if you're serious we can talk. We go back and forth on details etc. Then I say okay I am okay with selling let meet up and talk about it that way you can see the car. All goes well until we hit a bump, he then starts to tell me his personal issues etc. and he tell me he can't pay me all up front. I kinda hesitate speak to my wife and we decide lets help this kid. He come down looks at the car loves it, we talk about details and I say okay down 1500 ,keep in mind I don't know this kid from Pedro lol, and 500 in payments. He agrees we schedule another meet cause I needed to to a thermostat and bleed the water system. Week goes by he comes car was not done and I didn't feel good with him taking car since it kinda was over heating. He gave me a sob look I fell for it and said fine but its not bled correct.


    Nonetheless, we start looking at paper work etc shake hands and I ask for down. That is where it all starts only had 500.00 down and couldn't make payments of 500.00, I look at my wife and she gives me the don't be a jerk and say okay babe handle this fuck it I was upset. So we make deal he is to pay the remaining by next Friday. Friday comes around excuse this and that. I say okay so what are we going to do should I pick car up? no no please just give me time I do and this just keep happening time after time one thing or another for an excuse of why he can't pay.


    He now owes about 800.00 and today came up with another excuse what should I do. Sorry but I feel his problem isn't mines nor should I or he make it my issue. I want to kick his azz but my adviser the angel on my shoulder say's no and the devil say's come on stop being a fag . I am just fed up with this kid and I am in no way fucked up. From the people whom know me car was legit did need a top and brakes. I gave the kid all new brakes all around, master cylinder, and had all new suspension and ss exhaust system.


    All in all should I just say fuck it leave it alone, live and learn, or tax his azz for it?? Who the hell does what I do and gives a kid I don't even know a car and pink with a 500.00 deposit other than my dumb ass and now feel bad.

      This is quite common down here when dealing with not so "financially inclinded" individuals, AKA everyone on CL. Which is why you will read in CL ads "CASH UPFRONT, NO PAYMENTS". Call the police and get your car back, I hope you kept the title.

        U messed up, shoulda kept the title. Also, i would never ever ever ever realease something without full payment. I dont care what sob story he gives you.

              +1, this would have made life MUCH easier for you. Especially if you make payments non refundable. I've done this with a few minor items (never a whole car) and it works out nicely in the end.

                If your payment "contract" doesn't meet these six requirements you may be screwed.

                1. Agreement- which requires offer and acceptance.
                2. Considerations- money.
                3.Capacity to contract- Must not be minor, insane or intoxicated.
                4.Genuineness of Assent- intention of both parties when contract was entered into.
                5. Lawful purpose- must be for legal use in order to be a valid contract or enforceable contract.
                6. Lawful Form- if the law requires it to be in writing it must be.

                If it does, take him to court and get the money he owes you.

                  I know both parties and I feel for both, I hope everything works out in the end. I praise the seller for his good natured intentions, but I also know of the hardships the buyer has gone through.

                    Regardless if you can't afford something don't buy it.

                    Get your car back.

                    What if something happens to the car? Now your out a car and your cash.

                        I do not think that there should be any sympathy for the buy when it comes to payments. They made a deal and he needs to live up to it.

                        You can feel bad for him for the other hardhips, but he needs to pay.

                        Get car, or money back. I would tell him you want the rest of the down and to make a legit contract or you are notifying the police.
