I do not think that there should be any sympathy for the buy when it comes to payments. They made a deal and he needs to live up to it.
You can feel bad for him for the other hardhips, but he needs to pay.
Get car, or money back. I would tell him you want the rest of the down and to make a legit contract or you are notifying the police.Leave a comment:

What if something happens to the car? Now your out a car and your cash.

I know both parties and I feel for both, I hope everything works out in the end. I praise the seller for his good natured intentions, but I also know of the hardships the buyer has gone through.

If your payment "contract" doesn't meet these six requirements you may be screwed.
1. Agreement- which requires offer and acceptance.
2. Considerations- money.
3.Capacity to contract- Must not be minor, insane or intoxicated.
4.Genuineness of Assent- intention of both parties when contract was entered into.
5. Lawful purpose- must be for legal use in order to be a valid contract or enforceable contract.
6. Lawful Form- if the law requires it to be in writing it must be.

+1, this would have made life MUCH easier for you. Especially if you make payments non refundable. I've done this with a few minor items (never a whole car) and it works out nicely in the end.Leave a comment:

This is quite common down here when dealing with not so "financially inclinded" individuals, AKA everyone on CL. Which is why you will read in CL ads "CASH UPFRONT, NO PAYMENTS". Call the police and get your car back, I hope you kept the title.Leave a comment:
